NEB orders City of Burnaby to no longer impede Kinder Morgan's pipeline test drilling; Mayor of Burnaby vows to take this battle to federal court.

In a sea-saw legal conflict over the future of a multi-billion-dollar oil sands pipeline, the National Energy Board said it has ruled against the City of Burnaby in its attempts to block Kinder Morgan from doing its test pipeline drilling on Burnaby Mountain.

City staff have been ordered to no longer get in the way of the Texas-giant's efforts to access Burnaby Mountain's Conservation forest area.

The company will be able to legally proceed with its geo-technical work to explore the feasibility of an underground tunnel for its $5.4-billion Trans Mountain pipeline expansion project.

“The order also requires Trans Mountain to provide the City of Burnaby with 48 hours written notice before entering Burnaby Mountain to carry out the surveys and studies.”

“Furthermore, Trans Mountain must do as little damage as possible and remediate any damage it does cause, to the extent possible.”
states the board’s press release Thursday afternoon.

We'll see how committed they are when it comes time to crack open their wallets and pay the lawyers.

PS - Kinder Morgan has filed lawsuits against individuals that have (individually) blocked their completely legal operations... Expect many tears when the ecotards that did their thing for Mother Gaia are abandoned by their eco-Kin and pay through the nose.

KM managed to galvanize opposition by going in and clear-cutting portions of the dedicated Burnaby Mountain conservation area... along the way, as you say, they filed a lawsuit... not against individuals but against the group 'BROKE' (Burnaby Residents Opposing Kinder Morgan Expansion)... seeking $88 million in damages... apparently desiring to align the group's finances with its acronym!

I for one was in support of Kinder Morgan until they did the tree cutting thing
That demonstrated the company which has by and large been somewhat
community minded, was another arrogant multi national that can do what it
pleases. I hope they now tie this up in the courts for decades. Besides all
that has to happen is the city to win at the federal level and the group broke
could be on the receiving end of the suit.
I am no greenie but I hope they demonstrate to this company they can't do
what they like.

Biochemistry professor Lynne Quarmby and literature professor Stephen Collis were named as defendants in a high profile injunction application and civil suit designed to prevent people from interfering with the company’s survey work for the Trans Mountain pipeline expansion. The instructors, along with other citizens named in the case, could be facing fines, or damages in the millions of dollars claimed by the company.

PS - A pipeline right-of-way is supposed to be kept clear of trees, brush, etc in the event of a leak and/or general maintenance


A lot of people get their undies twisted over trees. Tree are good and necessary in their place and there are lots of places to grow them. On rights of way isn't one of them. It can be an issue where mentality is often sadly lacking.:)

I know we have so few trees here in B.C. that it is a moral crime to cut a couple down .
