New trial for Guy Turcotte, ex-doc who killed kids

MONTREAL — The Quebec Court of Appeal has ordered a new trial for Guy Turcotte, the former cardiologist found not criminally responsible for killing his two children.
The appeals court ruled Wednesday that trial Judge Marc David made a legal error in his instructions to the jury during a 2011 trial north of Montreal.
The Court of Appeal referred to the judge's instructions as "deficient," adding that they "had an impact on the verdict, which could have been different."
The Crown had said a not-criminally responsible verdict should not have been among the jury's options given that Turcotte drank methanol glass cleaner on the night of the killings.
Turcotte admitted that he killed son Olivier, 5, and Anne-Sophie, 3, amid a crumbling marriage in 2009.
But the ex-doctor said he was depressed suicidal and blacked out before killing them.
The court heard he stabbed his children 46 times and that his son begged for his life before the child was butchered.
The jury's decision not to send Turcotte to prison provoked outrage across Canada, prompting some people to call for the death penalty.
Though the appeals court cancelled the controversial verdict on Wednesday, the judges also recognized that "the trial judge had a difficult role to play" because "the prosecution did not always help him by offering a sometimes confused point of view."
Turcotte was freed from a mental hospital in December 2012. It wasn't immediately clear when he would be re-arrested.
His ex-wife Isabelle Gaston, who is also a doctor, says she still feels her life is in danger.

We've never fried anyone.


That is a crazy verdict. He admits he killed them. Whether he planned or intended to do it doesnt make a whole lot of difference. If he really did black out and had no idea what he was doing he is still dangerous as that can happen again. If he did then its just plain first degree murder.

I hope that this will mean that the proper verdict will be given to this piece of crap. He deserves to be locked away for the rest of his miserable life.

The former cardiologist was not present in the courtroom in St-Jerome, Que.
It was the same courthouse where Turcotte admitted during his first trial that he stabbed his son Olivier, 5, and daughter Anne-Sophie, 3, in 2009.
But a jury accepted his defence that he was suicidal and despondent prior to the killings because his marriage was crumbling.
The not-criminally-responsible verdict in 2011 provoked outrage across Canada, with some calling for the death penalty.
He now faces another first-degree murder trial after the Quebec Court of Appeal ruled that the trial judge erred in his instructions to the jury.
Turcotte, 41, was released from a Montreal mental hospital in December 2012.
He was re-arrested in November.

Of course he wants them to stop the second trial. He doesn't want to get the proper sentence he should have been given the first time. He's a murdering scumwad and should be treated as such.

Everything from the first round will stand including going loopy. The jury could decide the same verdict.

But he wasn't loopy. He did it to stick it to his ex-wife. I really hope the jury gets it right this time.
