ALEXANDRIA, Va. — A Muslim convert from Brooklyn was sentenced Friday to nearly 12 years in prison for posting online threats against the creators of the "South Park" television show and others he deemed enemies of Islam.

The sentence — largely in line with the term sought by prosecutors — came after Jesse Curtis Morton, 33, offered an apology for his conduct, saying he "contributed to a clash of civilizations" by espousing a violent ideology.

"I justified atrocities by Muslims simply because they were carried out by the weak against the powerful," Morton said.

Morton founded the now-defunct Revolution Muslim website. He said he wanted the site to offer a forum for nuanced dialogue on relations between the Muslim world and the West and that he thought his website was protected by the First Amendment. However, he admitted that the website devolved into coarse calls for violent jihad, and that he crossed the line by posting the al-Qaida magazine Inspire on the site. The magazine explicitly called for the murder of a cartoonist from Seattle who promoted "Everybody Draw Muhammad day" and featured an article titled "How to Make a Bomb in the Kitchen of Your Mom."

... how can you tell if a threat is serious or not?

The speech police do not have to differentiate, the onus is on whoever utters them to provide proof and don't hold your breath waiting for their sense of humor to kick in. Uttering death threats online or in public is as stupid as being serious about it is. Great opportunity at least for a Darwin award.

International treaty law has determined that threats cannot be made online. Violations of the law constitute a felony. Therefore, based on the facts as reported in this case (and proven in court) the sentence was valid. The Constitution's guarantee of free speech does not protect against threats of harm or the promotion of disorder in this or any other society.

If Muslims want to live in the West they have to accept the rough and tumble of free speech. Political speech is often designed to hurt feelings in order to force change. If the Pope can be verbally attacked so can Mohammed. It comes with the turf when one lives in the West.

Jesse Curtis Morton would not be in this situation had he contacted the lawyer that Omar Khadr used. In fact, he might have even been given the keys to the city and a cash award for the State hurting his feelings

Kind of a misguided reply, since in this case a man from Brooklyn converted to Islam then made death threats. He was already living in the west.

Take for instance the time honored tradition of American flag burning. Surefire way to get death threats in the US from other Americans. In some places it needs to be a confederate flag (I am told).
