A sleepy drinker with a BAC of .04 is more dangerous than a wide awake one at .04
Absolutely!

I'm happy with the 24hr roadside suspensions based on the professional opinon of the attending officer. I've lost too many friends and family to booze and dope to not support it.Not to some. They believe that the sleepy driver should be sent on his way and the wide awake driver should be thrown in jail. Then they try and claim it is a road safety issue....go figure.
0.04 in SK, Impairment is impairment. As a person who rarly drinks, two beer is enough to make me fumble and I won't dare drive. If there is a belief that .05 is the new threshold then the groups in question should lobby the Fed to change the law. Personally I think it is nothing less than making a few bucks off of an often emotional and raw subject for some.

There is a reason the term "alcohol is a factor" is used and not "alcohol was the cause"
Fail the dance in SK and you get a 24hr roadside whether you were drinking, getting high, on cough syrup or simply tired. Impaired is impaired is impaired.
Duh!!!!!!!!!!!
Reaction time, balance, cognative responses, all similar to alcohol impairment.Duh!!!!!!!!!!! Falling asleep at the wheel, icy roads, poor visibility, speed, hitting a frost boil, could also all be factors combined to form the cause.
How do they test for "tired"?
Leger D. The cost of sleep-related accidents: a report for the National Commission on Sleep Disorders Research. Sleep 1994;17:84-93Accidents related to sleep deprivation have been estimated to have an annual economic impact of $43 to $56 billion.

One would think but that doesn't stop some people from pulling out meaningless statistics when it suits their purpose.
It's not a factor in the crash, only a statistic that won't go in the "contributed to" column. If I have a beer after work and drive home, you run a red light stone cold sober and T-bone me, alcohol is a factor in that crash....statistically speaking.

Speed is also a factor. But then again, if the speed of the cars was 0, the accident would not have happened.

Is that the proffesional opinion of some 22 year old rookie who doesn't know his asshole from his breakfast or a 22 year veteran who doesn't like the way you look or something you said to him?
I have a problem with making the cops judges and juries on the side of the road. That is not how our charter and constitution is set up.
