Jilted ex-boyfriend puts up abortion billboard that sparks free speech, privacy court battle - Yahoo! News

Opinions?

To me, it's a pretty sick situation to be dragged into, especially if it was a miscarriage...... he could try and argue the "Free Speech" card, but the counter could also be "defamation of character" or "slander"

Oh well.... explains why she's no longer with him.... friggin nut job.

My opinion is that despite having seen the billboard, I have no idea who she is, where she lives, etc. How is she being defamed by him discussing himself?

The only nut jobs are people who think that a woman has a so called "right" to murder an unborn person.

If it is not born it is not a child. Study some biology . You can now study it free online. But reality might no coincide with your nutbar religious cult dogma.

Abortions is mean and stupid thing to do, and it is REALLY BAD thing that there are no millions of babies who suffered death by cruel and stupid females who don't deserve to be called mother.

Yet another stupid comment by a religious nutbar that puts cult dogma ahead of reality.

Lemme guess; it's a religious nutbar philosophy UNLESS it coincides with your beliefs... Then it is acceptable logic, right?

If this is an abortion debate, then the whole story seems a bit pointless to begin with. Of course, people will completely avoid the pertinent issue because it's meant to spark the abortion debate, but I'm guessing that was the intent of this piece.

This is not about whether abortion is wrong in the first place - that argument is losing its luster faster than catholics can denounce gays. The real story is that this is a conflict between biological parents about who gets to choose whether an abortion is reasonable and necessary.

Who gets to choose to kill the little fleshling - him or her?

That's not the debate at all mentalfloss. The debate is the lawsuit.

Is he allowed to say "I would have had a baby, but its mother killed it." Is that a breach of her privacy? Can you talk about the negative experiences in your life, name no names, and still be charged with breaching someone's privacy?

We have no idea if she did abort or miscarry it's about privacy. As I posted above she has obviously painted herself into a corner by coming forth and exposing herself which isn't a volattion of privacy. It was voluntary.

Is it any different than any other 100% natural biological function? If she had really nasty farts and he posted a billboard " My Ex-girlfriend's farts stink!" is he breaching privacy?

It depends. Even though he named no names to the public, I'm sure both parties' immediate family members will all know the good news.

But then this becomes a civil lawsuit and it would have to be shown that she sustained some sort of economic loss or clear pain and suffering in order to pursue for damages. I don't think the courts care that much about defamation unless there are tangible losses.

If a woman were to post a billboard for a group educating on women's rights, and put her face up there stating that she had been date raped, could ex boyfriends come after her for defamation? What if I were to post a billboard that said I grew up in an alcoholic home? Could my family come after me for breaching their privacy?

Your families know your news ANYway. When you enter into a relationship, you have no implied right to their silence about what's going on in your relationship, especially when it ends. Because it's not all your story, it's theirs too. So anyone who knows her probably already knew this had happened.

You must have misread my point because we agree. Without a name or picture there is no privacy breach.

Sorry... I knew we weren't disagreeing. But I wanted to put a finer point on it because what you'd posted was essentially an example that was, well, shallow and didn't really affect him. This isn't like having to put up with someone's farts, it's a deep injury (if it happened), to have your opinion made null and void on an issue like this. When it comes to the shallow stuff there's I think an implied social expectation that you'll keep things to yourself, but deep hurts, we don't expect people to stay silent about the things that affect them deeply like that.

Well this is why 'breach of privacy' is a misnomer, in my opinion.

Sometimes a breach of privacy can be harmless. Sometimes it can be harmful.

It all depends on what the outcome of the breach brings to the plaintiff.

He was obviously very hurt and apparently really wanted to be a dad but on the other hand I'm not quite sure he was mature enough.

I've known very few parents who were mature enough to be. They learn and grow. That's the kicker of modern society, people need to realize that by the time you're 'ready' for kids, you're often past the point of being able to have them naturally.

Here we witness the rantings of a person who is devoid of logic and reason and therefore needs to resort to name-calling.

The young man in the OP posted to the world to see what will never happen. Like the aborted (or miscarried) baby growing up and achieve possible greatness and success.

Can you imagine the Mom of Tim Tebow putting up a similar road side sign saying: "Look what happened when in spite of all the expert advice I carried my baby to term".
