For a person to be a criminal, he has to have the mental capacity to understand what a crime is. I'm not sure the POTUS possesses that degree of mental clarity.
It isn't like the Govt shut down the whole Mafia when jailing a few tax cheats.

It was maxed out a couple of decades back when America went to war in two places on the other side of the earth, simultaneously, a thousand plus miles apart and all re-supplied by continuous airlift conveyor belts.
