Ontario man's drug-trafficking case tossed over road-side strip search

By Colin Perkel, The Cdn Press

Published December 10, 2019

TORONTO — A man found with a significant amount of cocaine and heroin has had his case thrown out after a three-day trial because police strip-searched him on the side of a highway and delayed his access to a lawyer.

In his decision, Ontario Superior Court Justice Cary Boswell excluded incriminating evidence because officers violated Robert Cave's constitutional rights.

"I appreciate that police officers have dangerous jobs," Boswell wrote. "(But) there were steps the police could have taken to ensure their safety, short of pulling down Mr. Cave's pants at the roadside."

(OH? And perhaps the hug a thug judge might to PERSONALLY take the risk of showing cops THE RIGHT WAY of dealing with dangerous criminals?? As readers of my stuff will know - I have repeatedly invited LIE-berals to EXPLAIN what those alternative steps might be - with NO RESPONSE!!!!!!!!!!!!!!!!!!!!!!!!!!!!)

Court documents show Cave was arrested in November 2017 in Barrie, Ont., when Det. Const. Jason Breedon, acting on information about a suspected drug trafficker, stopped the vehicle Cave was in. A police check turned up information that Cave was considered "armed and dangerous," even though he had no criminal record and no outstanding charges.

(So the tip was right about drugs and maybe they just caught him in an unarmed moment with gun left elsewhere??????????????????)

At one point, Breedon noted a bulge in the crotch-area of Cave's pants. While the officer and suspect offered contradictory evidence about whether the subsequent search was consensual, Breedon and another officer pulled down Cave's pants — but not his underwear — to his thighs as he stood by the police vehicle.

(Considering that we recently saw a handcuffed Toronto drunk driver - who had ALREADY gone through a pat down before being arrested - and there he was -video taped in the back of a police cruiser on the way to jail - wiggling around so he could stash HIS GUN on the floor in hope of later denying it was his - there is little wonder that cops would take care in dealing with a hard core drug dealer!!!!)

(Clearly a simple police pat down DOES NOT always reveal what a criminal may be carrying and hiding - thus the NEED for a strip search!!!!!!!!!!!!!!!!!)

They found a sock containing cocaine tucked inside his boxer shorts.

The officers testified the search took only a few seconds and said Cave was never exposed to members of the public.

(Police vehicles are usually LARGER vehicles and thus a person standing behind one WOULD be screened from road and casual observers!!!!!!!!!!!!!!!!!!!!!!)

In his analysis, Boswell found Cave's arrest legal and the search of the truck he was in justified. In addition, the judge said, the bulge the officers observed in Cave's crotch area warranted further investigation for weapons or drugs.

"Where I have a difficulty is the manner in which the search was conducted," the judge said. "I am not satisfied that there were sufficiently exigent circumstances present to justify a roadside strip search."

(Ah yes- the usual LIE-beral hug a thug weasel words!!!!!!!!!!!!!!!!!!!!!!)

While the search of the handcuffed suspect was brief and involved male officers who did not touch his private parts, Boswell nevertheless found it violated Cave's rights.

(To bad about the public right to be free of drug addicts and dealers and potentially armed gang bangers!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!)

"I do not find that Mr. Cave consented to having his pants pulled down on the side of the road," Boswell wrote. "The manner in which the search was conducted was not discrete."

(I am sure Mr. Cave would be no more happy to have his pants pulled down at a police station either!! And yet always hypocrite LIE-berals have INSISTED that female jail guards have the right to work at male prisons - where they will be supervising men taking showers or using the toilet so where is the LIE-beral concern for public modesty in that??????????????????????????????????)

Cave testified he felt intimidated and humiliated and Boswell said he accepted the testimony.

(Oh gosh!! And what about the lives destroyed by his drug “product”?????????????)

The Supreme Court has made it clear strip searches are highly intrusive and humiliating, and need to be done carefully. Courts have since repeatedly stated the importance of ensuring such searches be carried out in maximum privacy.

(Yeah, yeah and what about cop safety while transporting prisoners WHO MAY BE ARMED?? And what about the reality of it being easier to buy drugs IN JAIL than on the street?? MORE strip searches seem to be NEEDED!!!!!!!!!!!!!!!!!!!!!!!!!!!)

Boswell also found police further violated Cave's rights by delaying his access to a lawyer for about 90 minutes after the arrest.

(OH DEAR ME!! A 90 minute delay until his lawyer arrived?? Our Justice of the Peace - the people who generally arrange bail - generally work 8 am - 4 pm so if Cave was arrested after 5pm he would BE SPENDING THE NIGHT IN JAIL ANYWAY - waiting for a Justice of the Peace to come back on duty - regardless of when his lawyer spoke to him!!!!!!!!!!!!!!!!!!!!)

"Society's interest in the adjudication of this case on its merits must give way in this instance," Boswell wrote. "Permitting the admission of the evidence seized from Mr. Cave, in light of the numerous charter breaches I have identified, would tend to bring the administration of justice into disrepute."

(IN the last party convention before the election - LIE-beral rank and file members made it clear they believe that all drugs- including Heroin and Cocaine should be legalized - so this judge is simply following standard LIE-beral practice in bending the rules to excuse a hard core drug dealer using a spurious interpretation of our LIE-beral written constitution - and the judge is FORCING poisonous LIE-beral values onto the long suffering general public!!!!!!!!!!!!!!!!!!!!)

Police in Guelph have issued a public apology to a man they say was wrongfully accused of voyeurism and possessing child pornography.
The force says Derrick Miller was arrested at Guelph’s City Hall on July 27, 2016 for possession of child pornography and voyeurism. The next day a press released was issued saying he had been charged with those offences.
Police say he was not, in fact, charged with either crime when the press release was sent out “or at any other time.”
In a statement Monday morning, police say Miller was not in possession of child porn or engaged in voyeurism.
The police service says it “sincerely apologizes” for the embarrassment and damage stemming from the incident.

And McClintik told LIE-berals she was a POOR MISS-GUIDED NATIVE - SO SHE GOT SENT

OUT OF MAXIMUM SECURITY JAIL INTO A NATIVE HEALING LODGE!!!!!!!!!!!!!!

Just a quaint little bunch of cottages for the VISITORS!!!!!!!!!!!!!!!!!!!!!!

OR - CONSIDER THIS LIE-beral MADE IN B.C. MESS::::::

Here is an article graphically illustrating the LIE-beral TOTAL LACK OF INTEREST in combatting crime of any sort!! With some comments of my own in brackets):

B.C. disbanded RCMP unit after report warned possible crime figure bought stake in casino

By Sam Cooper, Global News

Published January 15, 2020

A businessman “connected to Asian organized crime” was allowed by a British Columbia government employee to buy part of a B.C. Lottery Corp. casino, according to a confidential RCMP report obtained by Global News.

And the government employee was later hired in a B.C. casino.

(Isnt that nice- one hand washes the criminal taint off the other!!!!!!!!!!!!!!!!!!!!!)

The explosive accusation is just one example of organized crime’s alleged infiltration and corruption of B.C. government casinos, according to a January 2009 RCMP anti-illegal gaming unit report.

(Oh and this “explosive report” is just coming to light NOW?? A couple of YEARS AFTER some CBC reporters used govt tax money to illustrate HOW EASY it was to launder cash in B.C. Casinos with no questions asked!!!!!!!!!!!!!)

The report also contained jarring allegations of victimization, including that women with gambling debts in Asia were being trafficked to B.C. and forced into sex work, and that children in B.C. had been thrown in the trunk of a car and warned at gun-point that their father owed $300,000.

(LIE-berals are great believers in personal responsibility and accountability -for the general public!! Of course that LIE-beral MP with OVER TWO MILLION DOLLARS in gambling debts got much different help and treatment last year!!!!!)

The report argued the RCMP anti-illegal gaming unit (IIGET) should target the drug cartels using B.C. Lottery Corp. casinos in combination with illegal casinos, to launder money.

At the time the IIGET was funded by B.C. Lottery Corp., and was only permitted to target illegal casinos.

(ISNT THAT NICE- BC Lottery Corp used tax money to target ILLEGALS only!! And ignored the bad apples in its own ranks!!!!!!!!!!!!!!!!!!!!!!!!)

But three months later, instead of following the report’s recommendations, B.C.’s government defunded and disbanded the illegal gaming unit.

(One has to wonder if there were bribes or threats offered in exchange for THAT COZY CRIME POSITIVE DEAL???????????????????)

Critics of B.C.’s casino industry have long questioned the decision to kill the RCMP unit.

In an interview, former Crown prosecutor Sandy Garrossino said the confidential RCMP report — obtained through extensive freedom of information requests by Global News — “is shocking to the conscience” and points to “the appearance of corruption in the regulatory system.”

“I always believed in this report we would finally find this kind of detail, and it is so important it is finally coming to light,” Garrossino said.

“I can’t imagine why there should not be an investigation into what were the circumstances of disbanding the IIGET unit.”

B.C. government documents claim the decision was based on funding pressures in the B.C. Lottery Corp. and that IIGET was ineffective.

(Well sure- if you LIMIT the targets and HOG TIE the prosecutors -then there will NOT be useful results!!!!!!!!!)

READ MORE: Secret police study finds crime networks could have laundered over $1B through Vancouver homes in 2016

“Illegal and legal gaming have been interlinked”

(And how is THAT LINK any sort of surprise?? Have we learned NOTHING from the history of Las Vegas????????????????????????)

The January 2009 RCMP report stressed that money laundering between legal and illegal casinos was an integrity concern for B.C.’s government.

It said that organized crime could make big money in underground casinos, and “through the infiltration of legitimate gaming venues” easily launder and transfer the criminal proceeds.

And B.C. government and criminal casinos had become intertwined in a dirty economic loop, the report said, even sometimes sharing the same card dealers and loan-shark networks.

“Illegal and legal gaming share the same issues, such as loan-sharking, extortions, assaults, kidnappings and murders,” the report says. “And illegal and legal gaming have been interlinked when, in some cases, casino staff have directed patrons to loan sharks or to common gaming houses.”

READ MORE: B.C. casino ‘knowingly accepted’ millions from banned loan shark, audit alleges

These links between government facilities and underground casinos suggested that “corruption undermines the integrity of gaming in British Columbia,” the report said.

But in the case of one B.C. casino that is not identified in the report obtained by Global News, the organized crime connection was more fundamental and damaging to the integrity of gaming.

“More specific connections to Asian Organized Crime is/was through a subject, connected to Asian organized crime, who was allowed to buy into a casino,” the report said, pointing to an unidentified investor whose “casino business associates also have Asian Organized Crime connections.”

“The regulatory investigator, involved in the share transfer process, is alleged to have known about these connections when this subject originally bought into a casino,” the report said. “The regulatory investigator is now retired from the provincial government. However, he still appears to be involved in the legitimate gaming industry.”

(It would appear that our LIE-beral overlords take our IMMENSE, ECONOMY CRIPPLING DEBTS more seriously than we expected - so much so they are willing to endure organized crime and violence in exchange FOR A SHARE OF CASINO GRAVY!!!!!!!!)

In an interview, Denis Meunier, former deputy director of Canada’s anti-money laundering watchdog Fintrac, said the allegations of criminal connections and ownership in B.C. Lottery casinos are “explosive.”

“For licensing, casinos are expected to conduct due diligence on the owners, the employees and any associates, to ensure criminals and their associates are nowhere near casino ownership or operations,” Meunier said. “In my view, if (the criminal casino ownership allegations) were reported to anyone (in B.C. government and RCMP) and they were not further investigated, there is a breach. Because there is a fiduciary or legal responsibility to the public. This is shocking.”

The report does not identify the B.C. government employee that it alleges knowingly allowed a person connected to organized crime to buy into a B.C. casino, before taking a job with an unidentified casino company.

In an interview, Garossino said that a “revolving door on turbocharge,” involving former government and police employees that have taken jobs in the B.C. casino industry, has created dangers of corruption.

(This issue of govt employees joining groups they are supposed to be regulating extends even to Tesla Motors - which hired a former Wynne-bag “specialist” after Wynne-bag demonstrated her price gouging prowess with our electricity file!!!!!!)

“All of these (report allegations) are of a piece, of a mentality of turning a blind eye to criminality,” Garossino said. “Anyone connected to organized crime, it is a complete collapse of regulatory oversight that such an individual is allowed anywhere near a provincially-licensed gaming site, in terms of ownership or any stake.”

(As I have said before- LIE-berals long ago decided that fighting crime in any real way would be to COSTLY to bother with!!!!!!!!!!!!!!!!!!!!!!!!!!!!)

The minister responsible for reviewing the January 2009 RCMP report and the decision to disband IIGET, former B.C. solicitor general Rich Coleman, has stated the unit was ineffective.

But Garossino said she believes details in the report “shred the credibility” of the B.C. government’s explanation for shutting down IIGET.

“It is stunning to me that any government official would be provided this information, and the Solicitor General’s response was, rather than to grant police the resources they were seeking, to do the reverse, and disband this unit,” she said.

(LIE-berals DO NEED THEIR GRAVY to BUY VOTES!!!!!!!!!!!!!!!!!!!!!)

“Children were kidnapped and murders took place in the pursuit of money and the provincial government knew it."

"You have every appearance of human trafficking and women forced into prostitution. It’s not just that they did nothing, but they actively disbanded this unit. So it is as if that is an intervention in making the police stop, from looking at the corruption they wanted to probe.”

B.C. Liberal minister intervened to raise betting limits, ignoring money laundering warnings about Chinese VIPs

(Higher betting limits means more tax rake off for LIE-berals - and to hell with the ignorant general public!!!!!!!!!!!!!!!!!!!!!!!!!!!!!)

Grand jury drops case against Buffalo, N.Y. officers who shoved elderly man

Two Buffalo, New York, police officers who eluded criminal charges for shoving an elderly man to the ground at a protest last June still face an internal review that could go on for a year, a police spokesman said on Friday.

An Erie County prosecutor on Thursday said a grand jury declined to indict the officers, Aaron Torgalski and Robert McCabe, for the widely viewed shove of the 75-year-old man during a national wave of protests for racial justice.

The two officers were arraigned on felony assault charges two days after the June 4 demonstration outside City Hall in which local rights activist Martin Gugino was pushed to the ground and hit his head as police cleared the area.

Erie County District Attorney John Flynn Jr. said grand jurors voted to dismiss the case despite his own belief that a crime had been committed.

“We have a system in place here where society makes those decisions, not one person,” Flynn told a press conference. “And that’s the way it should be, and that’s the way it was.”

The officers remain suspended with pay pending the outcome of an internal affairs investigation, Buffalo police spokesman Captain Jeff Rinaldo said by email.

“There is a one-year timeline for the investigation to be completed,” Rinaldo added.

Flynn said he was duty-bound under state law to charge the officers with felony assault – even though he did not believe their actions “rose to the level of a felony.” He stressed that he presented a forceful case to the grand jury.

The video, shot by a local reporter and seen by tens of millions of people on the Internet, shows Torgalski pushing Gugino before he fell and McCabe about to kneel toward the man sprawled on the sidewalk before being moved along by a supervisor.

Gugino, who had approached the officers during the protest after a curfew had been imposed, was rushed to a hospital with a critical head injury, from which he recovered.

In an emailed statement, Gugino’s attorney, Kelly Zarcone, said: “Our position remains that the government’s use of unnecessary physical force against peaceful protesters is patently wrong and un-American.”

The Buffalo Police Benevolent Association hailed the grand jury’s decision, saying in a statement that the officers were simply following orders to clear the area.

A Halton Regional Police officer has been charged after video surfaced of a cop appearing to push a man to the ground in Oakville.

The video, filmed on April 8, 2020, doesn’t contain any dialogue and seems to show a uniformed officer repeatedly shoving a man in a plaza near Third Line and Dundas St. W. Halton Police said officers were called to that area for reports of a man loitering.

“We recognize that the actions of our officers at this incident have the potential to undermine public trust in our service, and in policing as a whole. We remain committed to fostering and maintaining a very positive relationship with the community we serve,” said Chief Stephen Tanner in a statement.

Halton Police suspended Mathers with pay, the only option available under the Police Services Act, the service said. Following the surfacing of the video, Tanner asked Waterloo Regional Police Service to launch a criminal investigation into the incident.

Henein Hutchison LLP, the law firm representing the civilian in the video, said in a statement Tuesday the man “at the time of this incident, was a vulnerable person who had just been discharged from hospital.”

“We would like to thank the good Samaritan who recorded the assault and harassment he endured and posted the video online. But for their quick-thinking, the officers’ misconduct would have gone unreported,” the statement reads.

“Though my client is grateful that the criminal investigation into this incident was handled by an outside police agency, and that charges have been laid, it should not represent the end of the matter. Three other police officers participated in his abuse and harassment. These officers stood by and did nothing to stop the harassment, continued assaults, and criminal conduct by their fellow officer.”

The other three officers who were in attendance at the incident were reassigned to administrative positions pending the outcome of the investigation by Waterloo Police.

Mathers has been released, Halton police said, and is scheduled to appear virtually in court on March 9.

He remains suspended with pay.

Halton Regional Police Association president Clayton Gillis declined comment Tuesday.

“Jay’s been represented by the association and his counsel and obviously, we know the charges were laid today and we’ll just let that process play out,” he said.

Halton police said it will now launch an internal disciplinary probe “into the actions of all four officers” under the Police Services Act.

“It is of paramount importance that any investigation into the actions of a police officer is not only thorough, but also unbiased, transparent and fair,” added Tanner.

VANCOUVER — A spokeswoman for Vancouver police says the conduct of two officers is under investigation after video footage emerged of the pair allegedly posing with a dead body at a popular beach.

Const. Tania Visintin says the officers responded to calls about a deceased individual at Stanley Park’s Third Beach, and waited for the coroner to arrive.

Visintin would not comment on the officers’ actions but says the police department does not condone, and strictly prohibits, officers taking photographs without an authorized purpose.

Zac Ratcliffe was in the area for a walk on Wednesday morning when he saw the body and police officers laughing and posing for photos in front of it.

He says he recorded the incident and posted it to social media because their actions angered him.

Visintin says the video has been provided to the Office of the Police Complaint Commissioner, which investigates municipal police force misconduct, and there will be a Police Act investigation.

A former police chief in Maryland was labeled as a serial arsonist by law enforcement officials on Thursday, a day after he was charged with setting a dozen fires over a span of nine years targeting his enemies.

David Crawford, 69, of Ellicott City who served as police chief in the city of Laurel before resigning in 2010, was arrested on Wednesday. He was charged with 24 counts of attempted first and second-degree murder and more than two dozen counts of arson and malicious burning, officials from several jurisdictions said during a press conference on Thursday.

Investigators said they found all of the fire victims had previous disagreements with Crawford. They said they found a target list of the victims while conducting a search of Crawford’s residence in January.

Lisa Myers, the police chief in Howard County where five of the suspicious fires were set, called the suspect a “serial arsonist” and a “dangerous criminal.”

Crawford was being held without bond in Howard County after a brief court hearing on Thursday, Myers said.

In addition to the fires in Howard County, Crawford is accused of setting two fires in Prince George’s County, three in Montgomery County and one Frederick County from 2011 to 2020. Another fire, set in 2019 in Charles County, is still under investigation.

The house, vehicle and garage fires were set by a suspect who was seen on surveillance video wearing a sweatshirt with the hood tightly drawn over his head. The suspect used gasoline and a stick wrapped in cloth to start the blazes, investigators said.

Law enforcement officials said they broke the case open during the investigation of the most recent blaze in Montgomery County on Nov. 17 when they discovered a link between the victims and Crawford, Prince George’s County Fire Department said in the statement.

The victims include a former City of Laurel official, three former law enforcement officials including a former City of Laurel Police Chief, two relatives and two of Crawford’s former physicians, law enforcement officials said.

He added, “If she’s going to insist I going topless, she needs to get her some 44DDs!!!”

The texts reviewed by the Bee, which police say were sent between January and August last year, were also often violent, sexual and disparaging to women, and included officers joking about beating up protesters and suggesting they would like to shoot a suspect in the face.

“Upon learning the details of the content in these reported communications I … was deeply saddened and disturbed,” Eureka Police Chief Steve Watson said in a statement on Facebook, noting that the department was still investigating the “veracity” of the messages. “While the exchange that reportedly occurred between officers was something that appears to have taken place on private devices, the subject matter discussed professional duties and was profoundly upsetting.”

Neither Reyna-Sanchez nor Meftah commented to the Bee; The Washington Post was not able to reach them late on Wednesday.

Dealing with the homeless has been a fraught issue in Eureka, a city of about 27,000 in Northern California. According to a 2019 grand jury report, there were more than 650 homeless people in the city, and 57% had been diagnosed with mental illness. The report accused police, along with city officials, of criminalizing the homeless by giving citations, which the grand jury called “counterproductive” and leading to more “mental anguish.”

The Bee reported that it received photographs of the group texts between Eureka police from an individual who requested anonymity, and published some of these exchanges online.

The group message reportedly consisted of six officers, all from the same squad, which was supervised by Reyna-Sanchez. Meftah and Reyna-Sanchez’s violent messages go back to last January, the Bee reported, when the officers spoke contemptuously about protesters.

“There’s supposed to be a protest at the courthouse from 1700 to 1900 for the ‘war in Iran’ . . . confirm u all have ur riot gear?? Gas mask, helmet, and dude handle,” Reyna-Sanchez wrote.

“I’ll beat those f***ing hippies down,” Officer Meftah wrote to the group.

“Why don’t I have a side handle??” Reyna-Sanchez responded, referring to a police baton.

In April 2020, Reyna-Sanchez reportedly ranted about a suspect who posted bail after police found his stash of guns. The suspect also had Reyna-Sanchez’s tactical vest.

“He also had one of my tac vests that I had loaned to code enforcement!! Face shoot the f—–!!!” the sergeant wrote, according to texts reviewed by the Bee. “He was one of my first arrests!!! Sent him to prison for a minute!!”

Reyna-Sanchez’s comment to “face shoot” the man comes 10 years after he fatally shot a 25-year-old robbery suspect in the head after he pointed his gun at an officer. Reyna-Sanchez was cleared of wrongdoing in the shooting.

There are also extensive comments that degrade women, the Bee reported. In messages about a new female officer-in-training joining their squad, Reyna-Sanchez expressed his annoyance by using vulgar and disparaging language.

“Seems the powers that be feel E Watch is too green to correct any issues that she has, and she had a lot of issues … so they’re putting her on days so that all u veteran officers can unf*** her …” Reyna-Sanchez wrote.

Then, in a response to an officer about the assignment, Reyna-Sanchez said: “Clearly they don’t see what I see … b**** be twice as big as u!!”

In another exchange, an officer said he spotted a mentally ill woman, who had a record of shoplifting, walking in town.

“Get pics of her rack!!” Reyna-Sanchez wrote, according to messages reviewed by the Bee, before adding more texts disparaging her body.

In April, as the coronavirus pandemic began to spread through the country, the pair joked about blowing off requests from public health officials to perform wellness checks on residents who may have covid, the Bee reported.

“My plan if I had to go there was to knock as lightly as humanly possible on the door, give him an eighth of a second to answer, and then leave,” Meftah wrote.

“The public health dr suggested we go there, knock loud and step back when he came to the door!!! Nice plan b****!!! I’ll be right behind u!!!” Reyna-Sanchez replied.

Later, Reyna-Sanchez sent an update and referred a covid patient as an “outbreak monkey.”

Watson, the police chief, said in a statement that he was shocked to see the messages and “deeply concerned” that they would cause residents to question the “professionalism” of his officers. He noted that in recent years the department has invested in trainings on implicit bias, diversity and crisis intervention.

“What has been reported, unequivocally, does NOT meet the professional standards to which we hold our public servants,” Watson said. “Transparency and accountability are required in the positions we fill, and you have my word that we won’t rest as we keep working to achieve the standard our community expects.”

Durham Regional Police said it has apologized to a Sunderland mother after police officers showed up at her home and informed her that her 30-year-old son, Tyler, had died in a single-vehicle crash the night before in Uxbridge.

Except that he didn’t.

“Yes, there was an incident that resulted with a mistaken identity after a fatal collision last weekend,” confirmed Acting Sgt. George Tudos on Friday.

“It’s very rare that someone would have all three identical names but in this specific case officers could only go with the information we had at our disposal. We were not able to positively identify the victim due to the circumstances of this tragic collision.”

The mother in question was identified by Uxbridge Times Journal as Suzie Macdonald, who said on March 13 at around 7 a.m., officers knocked on her door with the grave news.

The Toronto Sun could not reach Macdonald for comment on Friday.

“They told me my son was in an automobile accident and he didn’t make it,” she told the Times Journal. “They asked, ‘Does he live here or does he live in Stouffville?’ I said, ‘Neither. He lives in Bancroft’.”

According to the media outlet, Macdonald immediately thought of his son’s expectant wife in Bancroft who had another young kid at home. Family made the decision to drive to Bancroft to break the tragic news in person.

This turned out to be a case of mistaken identity. Macdonald would eventually be informed by her son’s in-law that Tyler was safe and sound at home.

The 32-year-old car crash victim had the same first and middle name as Tyler, but was a different man.

“They said, ‘We just got here. The van’s here and so is Tyler’,” Macdonald told the media outlet. “(Police) called me and said how mortified they were, how sorry they were to put me through that.”

She added she has accepted the police’s apology, given the unusual circumstances that led to the mistake.

Tudos said DRPS’ officer in charge of North Division has reviewed the incident and “has rectified the issue.”

“We have apologized to the Sunderland community member,” he said.

Const. Steve Williams exhibited “classic stalking behaviour” toward his ex-girlfriend, a London police lawyer said during closing submissions at the officer’s professional misconduct hearing Tuesday.

Williams, 44, is charged with three counts of discreditable conduct under the Police Services Act — the law under which police forces hold disciplinary hearings into alleged professional misconduct — related to allegations involving a former partner, who can be identified only as R.P. to protect her identity.

The tribunal has heard how Williams constantly contacted R.P., despite her repeatedly telling him to stop, and showed up at her Kitchener-area home and work after the couple had broken up.

“He will not leave her alone. It’s classic stalking behaviour and it’s unacceptable,” said David Migicovsky, counsel for London police.

After R.P. contacted Waterloo Regional police to report Williams’ behaviour, he ran five unauthorized checks on her in an internal police database, the tribunal heard.

Defence lawyer Scott Hutchison argued Williams may not have been an ideal boyfriend, but his behaviour didn’t bring discredit to London police.

“At no time did he use his status as a police officer to intimidate or influence her,” Hutchison said.

Hutchison also said the tribunal was presented with a one-sided version of the couple’s relationship.

“It is a far more complicated story than the one that Mr. Migicovsky has presented to you. A member of the public looking at this situation would want to understand the whole story,” he said.

But Migicovsky countered Williams had an opportunity to explain his view of the relationship. Migicovsky also said it doesn’t matter whether there were good periods during the couple’s nearly three-year relationship.

“What matters is people have individual rights to end relationships and not be harassed when doing so,” he said, noting Williams sometimes showed up at R.P.’s home while in uniform.

The on-again, off-again relationship finally ended in November 2017 after Williams was charged with sexual assault involving another ex-girlfriend and suspended from his job, the tribunal heard.

Less than a month later, Waterloo Regional police charged Williams with criminal harassment, being unlawfully in a dwelling and making a harassing phone call stemming from allegations made by R.P.

Williams, who has the same name as London’s police chief but isn’t related to him, pleaded guilty in criminal court to making a harassing phone call and two counts of breaching his release conditions. The remaining charges were withdrawn as part of a conditional discharge that gave him 12 months’ probation but spared him a criminal record.

In total, Williams faced nearly two dozen professional misconduct charges, but just four of them were related to allegations involving R.P. He pleaded guilty to one count of discreditable conduct and not guilty to two other counts. An insubordination charge was withdrawn.

Hearing officer Morris Elbers, a retired OPP superintendent, will deliver his decision by May 7.
