LOS ANGELES - California Highway Patrol is investigating a video showing an officer pummelling a woman alongside a Los Angeles freeway during an arrest that began with an attempt to stop her from walking into traffic, an agency spokeswoman said on Saturday.
The video, which was taken by a passing motorist, posted online and broadcast by local television stations, has caused an outcry from community activists who say the officer used excessive force in the arrest on Tuesday.
Officials from the Highway Patrol on Friday became aware of the video, which captures an incident that occurred on Interstate 10 in Los Angeles, and they have launched a use of force investigation, Sgt. Denise Joslin, an agency spokeswoman, said in an e-mail.
"We're looking at every possibility, every fact, every circumstance that have contributed to this situation and we're going to try to come to a just conclusion," Highway Patrol Assistant Chief Chris O'Quinn said at a news conference on Friday.
The officer arrived at the location after the Highway Patrol received a call about a woman walking by the side of the freeway, a statement from the Highway Patrol said.
After spotting the woman walking shoeless along the narrow shoulder of the freeway and stepping into traffic lanes, the officer told her to stop, the statement said. When the officer approached the woman she became "physically combative" and he arrested her in fear of her safety and his own, it said.
The video from the passing motorist shows the officer pull the woman to the ground at the edge of the freeway and straddle her, as he repeatedly punches her in the head.
Another man is seen in the video running up and helping the arresting officer. The Highway Patrol statement described that man as an off-duty police officer who helped the Highway Patrol officer put handcuffs on the woman.
Earl Ofari Hutchinson, founder of the Los Angeles Urban Policy Roundtable, and other local community activists criticized the arrest.
"Excessive force, abuse of authority, is not going to be tolerated," Hutchinson said at a news conference.
Joslin did not say if the officer was placed on leave or allowed to continue working.
The woman, whose name was not released, was hospitalized for evaluation but did not appear to have any physical injuries, Highway Patrol officials said.

The use of illegal steroids is rampant in the police community in order to gain that musclebound authoritative look they so crave.

He could've had this hundred pound woman handcuffed in 20 seconds but he chose to use her head as a punching bag instead

LOS ANGELES - Northern California prosecutors have decided against bringing criminal charges against a sheriff's deputy who shot and killed a 13-year-old boy who was carrying a plastic replica of an assault rifle that the officer mistook for a real gun.
The Sonoma County District Attorney's Office concluded in a report unveiled on Monday that deputy Erick Gelhaus "honestly and reasonably" believed he faced an imminent of threat of death or serious bodily harm to himself or others when he shot the youth, Andy Lopez, last October.
The eighth-grader, clad in a hooded sweatshirt, was walking near his home on the way to a friend's house in the wine-country town of Santa Rosa when Gelhaus and his partner spotted the boy from their patrol car carrying what appeared to be an AK-47.
The deputies stopped their car and ordered Andy to drop the gun, but as the youth turned toward the officers, Gelhaus saw the rifle barrel rise upward and he fired eight shots at the boy, according to police accounts of an incident that unfolded in a matter of seconds.
The gun in question turned out to be an imitation AK-47 capable of shooting pellets or BBs, investigators said. The orange tip of the barrel designed to distinguish the replica from a real gun had been broken off.
But Gelhaus, a veteran officer and firearms instructor with nearly 20 years of experience in the U.S. military, believed at the time that he faced a "do or die" situation and responded accordingly, the prosecutor's report said.
"Here the implementation of lethal force was a reasonable response under the circumstances," the 52-page concluded. "Therefore, the actions of Deputy Gelhaus were lawful and no criminal charges will be filed against him at this time."
District Attorney Jill Ravitch said that before releasing the findings of her investigation she contacted California Attorney General Kamala Harris to determine whether her office intended to conduct its own review of the case and that Harris has declined to do so.
The FBI launched its own inquiry into the shooting last October and Ravitch said her office's report would be forwarded to federal investigators as their probe continues.
The boy's parents also have filed a federal civil rights lawsuit against Gelhaus and Sonoma County.

Mountie shoots his partner while responding to weapons complaint

A Mountie is recovering after being shot by another officer while responding to a weapons complaint.
RCMP say the two officers were at an apartment complex Saturday when one of them fired his weapon, hitting the other.
The wounded officer was taken to hospital with non-life threatening injuries.

Interesting how the right wing Tea Baggers are noticeably absent from these revelations about cops and how they represent abusive government. Not only should they be complaining about the abuses, but they should also condemn the fact that taxpayers are forced to pay millions in compensation to those victims while the cops retire on taxpayer financed union pensions. Of course, that would entail a demonstration of sound minds and rational principle but that's demanding a lot from Tea Baggers and it's not likely to happen any time soon.

Sask. cop unloads 14 bullets into injured calf

A Mountie unloaded 14 rounds from his service pistol into a wounded calf on the loose in Warman, Sask., Monday.
RCMP received a call in the afternoon about a calf on the highway. The yearling, bred for rodeo bucking, was "bucking and kicking at people as they approached and had apparently suffered a broken leg."
Two Mounties and a local cop tried to capture the calf, to no avail.
"The owner requested that officers dispatch the calf out of concern for public safety and to alleviate the animal from further suffering," police said.
The cops decided to shoot the calf with an RCMP shotgun, but the animal's owner intervened, insisting a service pistol would be more effective.
But the Mountie tasked with shooting the calf had to unload 14 times in order to kill it.
"A veterinarian who attended at the scene advised the officer that several of the shots landed in an area of the animal's skull that would not have been effective."

I'm so sick of all this type of sh it! I am now legally armed all the time and will have no problem using force to arrest any cop who is using brutal and unnecessary force.

The biggest problems surrounding brutal force are fear amongst the citizens, the training to go straight to brutal force and the complete lack of action by other officers and authorities. We need to have these a$$holes charged, fired and jailed and if other cops or govt won't do it then the citizenry needs to step in with equal force to stop every instance we witness.

LOS ANGELES - Attorneys filed a lawsuit on Thursday on behalf of a woman whose arrest was caught on video when a California Highway Patrol officer threw her to the ground beside a Los Angeles freeway and punched her, an incident that angered civil rights groups.
The lawsuit filed in U.S. District Court in Los Angeles accused Highway Patrol officials of violating 51-year-old Marlene Pinnock's civil rights by allowing the arresting officer to use excessive force.
The video of the July 1 arrest, which was captured by a passing motorist, drew wide attention after it was posted online and broadcast by news stations.
Before the arrest, a Highway Patrol officer spotted Pinnock walking shoeless along the shoulder of the freeway and stepping into traffic lanes, and he told her to stop, the Highway Patrol said in a statement earlier this month.
When the officer approached her, she became combative and he arrested her in fear of her safety and his own, the Highway Patrol said. The video shows the officer throwing Pinnock to the ground at the edge of the freeway, straddling her and punching her in the head.
The lawsuit filed on Thursday alleges the officer struck her between 10 and 15 times.
"The conduct was so beyond the pale, so vicious," said John Burris, one of her attorneys. "I've never had a case where a woman has been beaten in this manner by an officer."
Kerri Rivas, a spokeswoman for the Highway Patrol, declined to comment on the lawsuit. The Highway Patrol has launched an investigation into the videotaped arrest, and the arresting officer has been reassigned to office work during the investigation, she said.
Pinnock was hospitalized for evaluation after the incident, the Highway Patrol said earlier this month.
The lawsuit said she was transferred to a mental health facility after the video became widely viewed online. She remains hospitalized, said Burris, who could not say if she was receiving mental care.
Attorneys for Pinnock in their lawsuit also accused the Highway Patrol of improperly using a search warrant to obtain records from her interactions with attorneys and physicians, and of taking her shredded dress from the day she was arrested.
Local civil rights activists have expressed outrage at the videotaped arrest, and the American Civil Liberties Union of Southern California also raised questions about it.

A Connecticut state trooper is due in court this fall for sentencing, after he was found guilty of stealing from a motorcyclist who was dying on the side of the road. Dash cam footage from the officer’s patrol car showed him stealing cash from the dying man, as well as a golden crucifix.
On Wednesday afternoon, Aaron “AJ” Huntsman, a 19-year veteran of the state police, pleaded guilty to two felony charges of third-degree larceny and tampering with evidence.
Although your average person would face up to ten years under these same charges, officer Huntsman is looking at a maximum of a year and a half, plus five years probation. He even has the ability to plead for a lesser sentence, just because he is a cop.
The victim of the theft was 49 year old John Scalesse, a former executive of a company called JAS Masonry. Scalesse was killed on Sept. 22, 2012 after his motorcycle crashed into a construction company truck on the highway.
In his dying moments, Scalesse was approached by officer Huntsman, who was the first cop to arrive on the scene. Huntsman walked over to where Scalesse was laying, bent down and picked up Scalesse’s gold chain and a roll of bills containing $3,700.

When asked about the money by Scalesse’s grieving father, Huntsman had said that that he didn’t see any money at the scene. The lie ultimately became exposed when the cash was found under the front seat of Huntsman’s patrol car.
According to State Police, Huntsman continued to claim that he was innocent, even after he was shown a video of him taking the money.

A New York City man died during an arrest — partially captured on amateur video — during which a plain-clothes police officer placed him in what appeared be a choke hold while several others brought him to the ground and struggled to place him in handcuffs.


Internal affairs investigators and prosecutors announced inquiries Friday into the death of Eric Garner, who died the evening before outside a Staten Island beauty salon. Garner, 43, had a heart attack as he struggled with officers trying to arrest him on suspicion of selling untaxed cigarettes, police said. An autopsy was scheduled for Friday.

Partial video of the confrontation obtained by the New York Daily News shows an officer placing what appears to be a choke hold on the 6-foot-3, 350-pound Garner, who can be heard complaining repeatedly that he can't breathe as at least four other officers bring him down. He then apparently loses consciousness.

The video shows the officer who apparently choked Garner using his hands to push Garner's face into the sidewalk.

"It was very troubling," Mayor Bill de Blasio said at a press conference Friday, promising a thorough investigation. "I watched it the same way a family member would watch it, and it was very sad to watch."

Police Commissioner William Bratton said the officer depicted in the video appeared to have employed a choke hold, the use of which is prohibited in the NYPD patrol guide because it can be fatal.

"Now the investigation will determine — was the actions that they took appropriate to the resistance that they were experiencing," he said.

Ramsey Orta, 22, shot the video posted by the newspaper. He told The Associated Press on Friday that he was sitting with Garner and discussing weekend plans before the confrontation with police. Garner had just broken up a fight between two other men when the police approached him, claiming they'd observed him selling loose cigarettes, Orta said.

"Before they even grabbed him, he told them he wasn't feeling good and that's why I pulled the camera out and started recording," said Orta, adding that Garner was asthmatic. "They could've just hopped out on the guys who were fighting, but they didn't bother to ask. They just jumped straight on him."

NEW YORK - A New York woman who is seven months pregnant complained on Monday that she was put in a chokehold by a New York police officer after barbecuing outside her home, fueling a controversy that has raged in the city following a man's death linked to the technique.
Rosan Miller, 27, told a news conference set up by civil rights advocates that she was in "a lot of pain," following the incident, which was recorded on cell phone video and shown to reporters. Miller said police questioned her and her husband, Moses Miller, 34, on Saturday for grilling outside their Brooklyn home before the scuffle took place.
"The community is traumatized," said former City Council member Charles Barron who stood beside Miller at the conference.
"And, all for what. All for what? Barbecuing?" he said.
The allegation comes days after a Staten Island man, Eric Garner, died in police custody after being put in an apparent chokehold by an officer during an arrest for selling untaxed cigarettes.
Chokeholds have been banned within the department for over two decades, but in recent weeks several videos showing police using the technique have surfaced prompting widespread outrage.
Miller's arrest was under review by the NYPD's Internal Affairs Bureau, police said. Police declined to give further detail on what specifically they were investigating.
Police said Rosan Miller was given a summons for disorderly conduct, while her husband and his brother, 29-year old John Miller, were arrested on misdemeanor counts of harassment and obstructing governmental administration.
Mayor Bill de Blasio, who came into office promising to mend frayed relations between police and the city's Black and Latino communities, addressed the growing controversy of NYPD chokeholds and expressed concern about Miller's case at a news conference on Monday.
"We've made clear, both the commissioner and I, what our view is on the use of chokeholds. And it's not acceptable under any normal circumstances. But I don't want to rush to judgment," de Blasio said.
Police said last week that they were probing the arrest of a man who said he was placed in a chokehold after walking past the turnstiles at a Manhattan subway station without paying a fare and refusing to show police his identification.
The Civilian Complaint Review Board said last week it had launched a comprehensive study on the 1,022 chokehold allegations against the police it received from 2009 to 2013.

Why is it the mentality of cops to resort to violence over the stupidest things? The apparent policy of establishing dominance by any means is going to eventually lead to cops getting beaten or killed. I can only surmise these uniformed morons were not ever taught to use their words by their parents. It is no wonder domestic violence is prevalent, yet unfortunately rarely prosecuted, amongst law enforcement employees.
