Straight man 'gay-bashed' in Surrey

A 25-year-old Surrey man claims he was badly beaten as a victim of gay bashing, even though he's not gay.

In a YouTube video, Kerry Tyler Street says it isn't the first time he has been beaten up because a total stranger thought he was homosexual.

In the video, Street shows four missing teeth and a broken nose and jaw — the result, he says, of an attack in Surrey's Guildford neighbourhood Wednesday afternoon.

Street says he was skateboarding along 104th Avenue near 146th Street when he passed a complete stranger who was about 6 feet tall and in his 20s or 30s.

The man allegedly punched Street in the face, knocking him violently to the ground and then allegedly began kicking him.

"I was very, very sad that somebody would do that sort of thing," said Street's father, Brian.

"He does like to wear mohawks and coloured hair, but as far as I know, that's not illegal anywhere. He's just a skateboarder and he works in construction and sings in pubs."

Street underwent dental surgery Friday to remove his four broken teeth. His family says they have launched an online campaign to help pay for the surgery.

Meanwhile, Surrey RCMP say they are treating the case as a serious assault, but not a hate crime.

I've always said that the law doesn't make sense....
If I punch out a guy while calling him a cock-sucker, and he's straight I get a fine...

You're right and that's not what the intention of the hate laws are supposed to be. I think a targeted hatred like some can and do have for some minority groups does exist though. Sigh, I've said it before but I'd much rather see Hate Crimes go off the books and be replaced by the option to include it as some kind of 'special circumstance' when determining sentencing.

Both should be hate crimes. They are motivated by hate. The RCMP is incorrect in their non-application in this case.

Or neither one should be hate crimes. Rarely are any crimes motivated by hugs and puppies.

If you beat a random guy up on the street, its probably a hate crime. If you get in an argument and fight with a buddy or somebody at a bar, its probably just assault.

But before the introduction of the Hate Crime, whether you punched your buddy in the face or some random stranger, you were charged with assault. And that worked just fine. Introducing Hate Crime laws just provides to much opportunity for people to abuse that designation. Which is the reason I'd rather see it brought in on the back end with sentencing, because I do think there are bigoted *******s out there that will take out their bigoted hate on someone.

Just my opinion.

There is something to be said for simplicity but I don't think the old system was working. The guy who seeks out somebody to hurt certainly deserves a harsher sentence than a guy caught in circumstances which plain assault does not take into account. I can certainly see the distinction between degrees of assault. And their is room for improvement on identification of what a hate crime is. The OP guy should qualify. My opinion. We can agree to disagree of course (unless you want to change your mind.)

There should most definitely be a distinction on degrees of assault but I think it should be based on severity. The rest is all about sentencing, which we don't do right as far as I'm concerned.

Sounds to me like it was a targeted "gay-bashing". It should be recognized as a hate crime and pursued as such.

Clearly, the assailant is a waste of skin.
However, we don't know that this attack was motivated by homophobia.

The fact is the tough-guy crew in Surrey uses 'faggot' to denigrate pretty much anyone they don't like.
There's a good chance this guy was on steroids, and when a skater got too close to his precious car, he decided to beat the krap out of him.
