An example: a low life with a criminal record, from a 3rd world country, comes into the country illegally. Because of the darn charter, he is clothed, housed and fed on our tax dollars. Without the charter he is put on a leaky boat back to where he came from.
Charter has nothing to do with that, Risus, that is the government policy. Charter doesn’t say that Canada must give shelter to illegal aliens, most of the Charter provisions do not even apply to non citizens (only a few of them do), those on temporary visa here or those who are here illegally.
But if the government decides to deport somebody like that immediately, Charter won’t stop the government from doing so. Perhaps he may be able to appeal, but while the appeal is being processed, he can be imprisoned.
What you are talking of here is the government policy, it has nothing to do with Charter. The status of an illegal alien today is no different from it was in pre Charter days.
