On that premise it should be illegal to step out of your house because there is much risk of danger when you do.
That might be the reason why alcohol is restricted with it's consumption limited to at home or designated facilities. You can't drink in public and being drunk in public is illegal too. A parking lot is a public place.

I wasn't talking about alcohol. It should be illegal to send our kids to school because of the risk of danger...

Not only is the premise ludicrous but I reiterate that a charge of 'care & control' for sleeping in the back seat is a criminal charge for a possible future event. I guess the govt has this set-up hidden from us somewhere....

At issue is not what the law says. It is the stupidity of the law. Giving a guy a criminal record because he wants to get warm is stupid....end of discussion.

Wrong. My car is private property. That is why cops need your permission or a warrant to search it.

When pulled over by a cop have you never had him shine his flashlight in there without asking your permission?

They are looking for things in plain view as they are allowed to. What they cannot do is pull you out and go into the glove box or under the seats etc. You might want to learn the law and your rights.

My response is "get a warrant to seize it and then get a warrant to search it". I would also make sure they were clear on if I am under arrest and for what. If they give the old "detained" routine I am driving away. I am not going to give them a free pass around the laws they are supposed to adhere to. I would also file a complaint that they are placing me under duress by threatening to seize my vehicle and lock me up so any permission I might have given is void.

I know they will make such threats along with things like loading up charges, making it worse in front of the judge, I have even heard of them threatening to cut the car apart thus destroying personal property. These are all hollow threats if you actually know your rights.

They don't need a warrant if there is something in plain view that gives them suspicion. That's the whole point of the roadside stop and the casual glance in the back seat.
