Great defense that protects Officers.
I did not mean for the man to die. I forgot these chokeholds were banned.
Any non Police Officer using such a defense would have a high probability of being indicted at the least, and possibly convicted.

So, are you saying that you can prove that he had malicious intent? That he meant to kill the guy? That the whole purpose of his restraint hold was to kill the guy?

The grand jury didn't think so, hence the failure to indict.

But that is what the grand jury was tasked at looking at. Was there malicious intent. It could not be proven, so the GJ did not hand down an indictment. Now, if you want to be pissed at someone, then get pissed at the DA for limiting the indictment.

CHP Commissioner Joe Farrow confirmed the settlement in an emailed statement and an attorney for Marlene Pinnock confirmed the dollar amount for The Associated Press.

Wednesday’s agreement came after a nine-hour mediation session in Los Angeles.

“When this incident occurred, I promised that I would look into it and vowed a swift resolution,” Farrow’s statement said. “Today, we have worked constructively to reach a settlement agreement that is satisfactory to all parties involved.”

The statement said that Officer Daniel Andrew, who joined the CHP in 2012 and has been on paid administrative leave since the incident, “has elected to resign.”

Andrew could still be charged criminally in the case. The CHP forwarded the results of its investigation of the incident to Los Angeles County prosecutors last month, saying he could face serious charges but none have been filed yet.

The bulk of the settlement will take the form of a special needs trust for Pinnock, the CHP said.

Never mind that. Show me in the video of the incident that is the subject of this thread how the video alone proves the officer's intent to kill. Because I've seen that sentiment expressed several times on this subject.

Were his actions stupid, reckless, unnecessary? Yeah, probably. But were they intentionally meant to cause death? Because homicide and manslaughter I believe were the charges being considered.

You get between NY City Hall and it's Cigarette Tax Money they are sending a posse after you as was clearly shown.


NY City is just as addicted to nicotine as the smoker is. They are so addicted that they'll send a Police Task Force after you if your selling single cigarettes.

Was he strangled and the cause of death asphyxiation by strangulation?

Personally I think the whole thing is all kinds of fukked up. But if I'm not mistaken it was actually the coroner who labeled cause of death as 'homicide'. And homicide, again if I'm not mistaken, requires proof of intent.

And that whole "strangler" bit from HuffPost was just beyond the pale. Do they also bring gasoline to bonfires?
