yes, I agree. At this point though, it isn't an issue up here that I know of. And if it does become one, there will be no 2nd amendment to argue from.

An eyewitness said Mr. Bishop spotted a wounded invader falling in the snow and struggling to get up. Mr. Bishop raised his gun and fired at him, killing him. He fired at others scattering away, emptying his clip

thats a cold blooded kill right there if that is what happened..... If the person was incapacitated, and he is "leaking on the ground" then why go through and shoot him dead? We dont do mercy killings in Canada.... At that point in my opinion he let himself become overwhlemed with adrenaline....

Shooting in the air and yelling out "Heres Johnny" is sufficient force at that point.... Especially if the intruders ran out the house screaming.... This kid ended up becoming like the gangsters that picked on him...

Not necessarily, but your take on the situation is definitely plausible. It is not enough to overrule self-defense that the person was on the ground; that was the point of the appeal overturning the lower decision. There were five assailants besieging his home. Did he know where they all were? Did he know the person was incapacitated and not just prone from tripping? A rational person would likely still be in fear of their life, and knowing that these assailants were armed and determined perhaps an argument can be made that the shooting was proportionate to the threat.

Perhaps.

Just because an attempted murderer falls over, doesn't mean the would be victim's state of mind immediately returns to normal.

It is not reasonable to expect Mr. Bishop to behave 100% like a calm and rational person until he is no longer feeling the effect of fear for his life.

On the other hand, shooting an attacker a second time is a perfectly rational action for someone who is scared for their life.
