It would seem to me that if an officer suspects me of consuming cannabis, I should have the right to just volunteer a blood sample. There should be no reason to force me to waste my time with unreliable tests once I volunteer for a blood sample. Once I volunteer a blood sample, the officer should legally be required to register my ID, take the blood sample, and let me go. If the officer is still concerned, he could drive me home. Other than that, he should let me go and let the blood test handle the rest.

Upto 3hrs after a joint is impaired driving. A blood sample can go back weeks if not months.

Go ahead, hang yourself.

A real Libertarian wouldn't say a word to a cop.

I think that traces of pot remain in your blood for 30 days. Not enough to claim impairment, but enough to put you on a neighbourhood watch list.

LOnger than that depending on length of use. A hair sample can show for 6 months. The only test I would even consider for roadside is a swab because it won't show anything more than about 12 hours old for pot. Cocaine is about 2 hrs.or less. Yes it takes time to get results but if the cop is prepared to drive the suspect home and give a 24 hr suspension it doesn't really matter. The problem is there are so very many drugs both legal and illegal that can cause impalement that a roadside test for Marijuana is almost pointless if it is about road safety. If it is just another revenue stream for cash strapped governments then test away.

WE are required to swab tests for pre employment in most places.

How do you hang yourself by volunteering a blood sample if there is no weed in your system. That's the whole point of volunterring a blood sample. The sad part though is that a simple and reliable blood sample is not a part of the test in most departments. Instead, they rely on unreliable behavioural tests even if you volunteer a blood sample.

Drive them home? That's hilarious.

Better than administering an unreliable test.

You'll still get a 24hr roadside, vehicle impounded and walk home.

Ask for a swab and drive home without any hassles.

Nobody in Canada is getting arrested for this.

You cannot arrest someone for this in Canada.

This is a non Canadian story. If a cop thinks you are weed impaired he can give you a 24 hour roadside suspension and that's it. You don't drive home.


It is absolutely pointless to test someone and get the result a week later.
