vanni,
I'm glad we agree that whether there is a law in place doesn't have any bearing as to whether the law is valid. Finally!!! We've now established that the legality of a situation has nothing to do with whether it should continue to be illegal,
I don't necessarily agree with this at all...if a group has a strong enough case to challenge the Charter then I say go for it...but if not, and they lose, then I don't want to hear them piss and moan about it...

By the way I do know the difference between sodomy and homosexuality but I think we can agree that this law was directly aimed at homosexuals.
Nope...I don't agree with that either...

NAMBLA, isn't interested in furthering a cause which would allow adults to have sex with young children but rather with teenagers. Teenagers are technically children, however, NAMBLA argues that since teenagers have the choice to have sex with their peers, these same teenagers then have the choice to have sex. Period.
That teens have a choice to have sex with their peers has nothing to do with legality...you seem to imply that this behaviour is condoned by the courts, which I'm pretty sure it is not...not prosecuting a twelve year old for sexual assualt with a minor is not the same as condoning the behaviour...which is why this NAMBLA will never be sanctioned by the court to have sex with children...because they are still just perverts wanting to have sex with children...your case for NAMBLA will not be made with me...

As I pointed out to RB in an earlier post, I think we can all agree that paedophiles, polygamists and adult incest are certainly within the minority of Canadians. They are certainly persecuted(some legally) and ostracized.
Yes they are a minority...however, with all of your definitions of the word minority, you've missed the mark once again...
The word minority only appears in the Charter with respect to language, and in the Canada Human Rights Act, the word does not appear at all...which makes sense, as it would be descriminatory to classify different groups as minorities...so none of your definitions of minority have any bearing on this discussion...
I don't consider locking up pedophiles to be discriminating against them...neither would I think that of polygamists...they would have broken the law...and section 1 of the Charter deals with that...
1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.
So...before your argument can have any merit, polygamy, and pedophilia laws would have to be repealed...
For my part, I don't have a whole lot to say against polygamy...so long as it is consentual between adults...and does not become the scenario that peapod posted a few days ago...
NAMBLA/pedophiles will never gain equality in Canada, because they are the predatory defilers of children and deserve whatever punishment the law can muster...
