The family of a man killed by a Manteca police officer wants to give the public a chance to decide for itself whether or not the shooting was justified by releasing “dash cam” video of the incident.

The video shows Officer John Moody with his gun drawn, commanding Ernest Duenez Jr. to not move.

A report issued this week by the San Joaquin County District Attorney rules the shooting justified. It says the officer was aware that Duenez was a Parolee at Large, armed with a throwing knife.

The DA cites video experts saying a knife is visible upon close inspection.

Members of the Duenez family don’t see a weapon in Ernest’s hands when they watch the video or any sign of Ernest threatening the officer.

“There’s nothing showing this officer, this trained officer, was threatened,” said Duenez’s mother, Rosemary.

Citing a lawsuit pending against them, the City of Manteca and the police department would not comment.

Attorneys representing the family hope, by releasing the “dash cam” video, federal investigators will be implored to do their own analysis.

Looks to me like a premature trigger finger. I don't see a knife or any threatening movements. Why is the cop yelling about a knife when he is still behind the truck and the victim is still inside, does he have cray vision? Also why is the cop searching frantically for a knife that doesn't seem to be anywhere.

It's unfortunate that Duenez' foot was caught in the seat belt. He may have been trying to obey the lawful commands of Officer Moody, to get down. Since he ignored the lawful commands to not move.

There is most definitely something in Duenez' right hand when he places it on the roof of the cab.

It isn't surprising the knife was found in the bed of the truck.

Perhaps if he didn't move when he was ordered not to, he'd still be alive.

Sometimes in the early'90,s I was coming back to Kap from Sudbury with a 44Magnum RugerBlackhawk..I had just purchased there...
Somewhere around the 560 cut-off, Therewas a road block with several police cars armed to the teeth
Shotgun and their hands on theirsidearms when they approached my truck.
As soon as I stopped I took the keysout of the ignition, and handed them to the officer that opened mytruck door, keeping my hands in plain sight.

Once I was outside, he asked me why Ihad done that. I told him because so many armed officers meantsomething was going on, and told him of the revolver behind the backseat and the keys to the regulation lock box were on the key ring andall the paperwork from the Sudbury OPP were in the box.

After inspecting everything and givingme back my keys, he told me that they were looking for some armedsuspects and I was not to stop for anyone but uniformed officers, andthat he would call ahead so I wouldn't be stopped along the way.

When he closed my door he thanked mefor being so forthright with him...and two more check points just waved me through......

And as yyou know, I had my run in with the OPP on similar circumstances.

Funny how well both things worked out so well for us.

Must have something to do with simply being forthright and complying with lawful commands.

The fire fighters and cops around here sport this neat little flip knife with a cool gadget that looks more like a milk bag cutter, but works quite well as a gutting blade.

It goes through the pelt so well, I got me one.

It goes through the pelt so well, I got me one.

When I was on the ambulance (that's a while back) we had seat belt shears, (Fancy name for heavy duty scissors) and a small punch that would just shatter a windshield in our kit, and apparently the OPP had the same thing.
