Good question. I am divided on an answer. I'm not sure I accept the feminist BS that a husband can rape his legally bound wife. I know this puts me out of step with most other women, but there you have it. I do think drugging her was a bit much, but rape? Well, he is her husband after all!

Marriage does not give your husband any right to sex. Marriage gives you an obligation to try to make sure that your sex life is functioning well, and that both of you are happy, but it gives him no guarantee or right to your body.

rape is rape is rape. This was not about love, or even sex for that matter. he shoved wine bottles up her ____ for pete's sake. No one has a right to do that kind of thing to another human being unless they are in 100% agreement on the issue.

So lets review the situation.

A sexual assault case can't proceed without a victim. The acts were filmed and stored on a computer. The woman was drugged and unconscious. She cannot give consent while unconscious. Being married doesn't imply any rights as far as sex goes. Consentual sex takes two consenting people, a sexual assault is one perp and one victim who does not give consent. Marriage does not imply that this man has any rights regardless of the fact they're married. Look up the rape shield law, I'm not sure if they have it in Australia, but it basically says that prior sexual experiences is not a valid defence for the accused.

There was nothing in the article that said she WASN'T having sex with him before. It's a flawed assumption that he was drugging and raping her, simply due to a lack of conventional sex. Men don't do the kinds of things he did, simply due to sexual frustration. If he was simply frustrated, he could have just done the deed, gotten off, and no one would have been any the wiser. What he did is degrade her and document it. It takes it into a whole different class of crime.

Show me where the article said they weren't having sex. They may have been having perfectly normal sex outside of what occured.

Drugging your wife and stuffing objects up her ____ is not a right you have as a husband, and if you think it is, you might want to seek counselling.

Marriage is a sacred trust between two people to care for one another and build a life together. You're right in a way, in that sex is a huge part of that trust, but it's not a duty, or a right. It's a basis for a healthy relationship. That being said, there's no reason to believe he wasn't getting sex. There's nothing in the article that says they didn't have a great sex life outside of the rapes. The motivation behind what he did is not simply sex.

Ded right, Ton. According to Merriam-Webster rape is "unlawful sexual activity and usually sexual intercourse carried out forcibly or under threat of injury against the will usually of a female or with a person who is beneath a certain age or incapable of valid consent".
So if someone is uconscious, they cannot give consent to any sexual actiivity. Any sexual activity inflicted upon an unconscious person is rape. Apparently there are several handbooks:

the answer however, is NOT to push your penis into her dry, un-lubricated vagina, causing bruising and unbearable pain, and a whole series of psychological trauma.

have u though that maybe u could talk to your wife is she doesnt want sex? and if it turns out unresolvable, divorce her on the grounds of on non-consummation?

Wife drugs husband, inserts objects in his anus, takes pictures and pretends when he awakens that nothing happened.... but that's alright, it's his duty to provide her with sex. It couldn't possibly be construed as rape, right?

Give me a break.

another point which, in my opinion, is good, is that we can't know what happened and why because we werent there. There's also a good chance the judge doesnt know either.
