And under the law, if you wake up having been raped (or suspecting you've been raped) while black out drunk, you can go to the police or press charges exactly the same way a woman can. The law is not discriminatory.

Correct, however the operative phrase is "no evidence". If there is no evidence there should be no charge. Simple Simon.

Parts of the law can be discriminatory. That's why lawyers make Charter challenges. If the judge agrees with defence counsel, remedies range from tossing out evidence to declaring part of a law unconstitutional. It ain't rocket science.

Of course. This isn't the middle ages where only nobility could afford their law. But if cops investigate and (and this is what the entire argument is predicated on) find "no evidence", no charges should be laid.

Actually, Officers have discretion as well. They only submit to the crown for the laying of charges when they are unsure.

Thanks to cases where police were lax in the past, they usually err on the side of caution, and lay charges on the complaint, and let them work it out in court, to protect themselves.
