Only if the prosecution wants it that way. There are capital crimes that are tried without the prosecution seeking a death penalty which pretty much takes it off the table.

Only one problem with that..............they have to keep feeding him and paying someone to muck out his cell periodically! As far as appeals go even if he's not on death row he's probably entitled to an appeal every year or so probably running into $thousands.

Regardless of which way you lean on the death penalty, the reasons for doing it or not doing it should not be economic.

You are absolutely right .................there are three reasons for doing it, not the least of which is an 8 year old boy, that he selfishly murdered with a pressure cooker bomb. There is no way that f**ker should be walking the planet. This is not a case where there is doubt as to the identity of the perpetrator.
