[12] Mr. Khadr does not suggest that the government is obliged to request the repatriation of all Canadian citizens held abroad in suspect circumstances.* Rather, his contention is that the conduct of the government of Canada in connection with his detention by the U.S. military in Guantanamo Bay, and in particular Canada’s collaboration with the U.S. government in 2003 and 2004, violated his rights under the Charter*, and requires as a remedy that the government now request his return to Canada

Do you know what this means? it means that Khadr doesn't have the right to repatriation. His claim is that repatriation would be the correct "remedy" for being interrogated while being sleep deprived.

I'm sleep deprived, too, someone please send me a million dollars.

Don't need to read the decision. The scoc ruled exclusively on a one dimensional issue without considering the cold blooded murder.

Khadr gets no quarter from most Canadians.

Their job was to rule on 1 issue. They aren't supposed to account for his daddy beat his a$$ or he was bottle-fed vs boobies.

You're a sleep-deprived idiot!

Cherry-picking 2 lines from an entire judgement does not make any point at all.

If you are sleep deprived it wasn't done to you during an illegal imprisonment with the assistance of your government so NO, you don't get any coin for self-inflicted harm.

You'll notice that I referred to it being a one dimensional issue

You seemed to be complaining they did not take anything else into account. I was pointing out that their job is to NOT take anything else into account. If you're gonna complain about people doing their job correctly you might be better to keep quiet.

How long have you? The SCOC made their ruling based on our present day laws. If you and "70%" of the Canadian population don't like the law, then get it changed. If you're not willing to do that, then shut the f uck up, cause all you are is a whiny little bitch.

... But you know best AND you are the only judge that matters.

PS - just love the fact that whenever someone disagrees with you, your only reaction is a violent outburst.. Sounds just like your boy Khadr

So don't keep quiet and continue to look stupid along with 70% of Canadians.

As much as I hate the arrogant little pi$$ant he has done nothing wrong in this situation.

It was the Chretien/Martin government that put us in bed with the Americans for an illegal invasion and occupation of a sovereign nation. It was them who allowed a Canadian citizen to be illegally imprisoned and tortured. Trudeau did nothing but follow the ruling of the SCoC.

Actually, at this time, the SCOC are the only judges that matter.

The libs made the most cost effective decision. Taking this to court would have cost multiple 10s of millions of dollars more than what it did cost when the court costs and the increased cost of the settlement is factored in.

I've heard that passionate sentiment before.. At Waco Tx and Jonestown.

... You and Gerry must be in the know

Pretty sure Kahdr was a child soldier....not a cult leader.....thanks for playing...I think...LOL!

Did the supreme court award damages ?

Supreme court doesn't award damages. Their ruling would be used as the basis for further litigation starting at the lower levels.

The UN's definition of child soldier exempted Khadr as being such... Argument(s) posted earlier in this thread.

As per the cult leader comment, all of the followers acted so voluntarily.

... You missed the point by miles

Something about this stinks really bad when the proceedings and findings are done so in a manner that made it nearly impossible for the US group to act in trying to get their financial award.

... It never works that fast and the optics are that the Feds acted in a manner that facilitated it.

So you agree Kahdr wasn't a volunteer, that's a start.

Let the American's sue. He has $10.5 million for them to go after. Personally I wouldn't award them a penny since either they were in an illegal invasion and occupation of a foreign sovereign nation therefore committing crimes and not able to claim compensation or they were involved in a war which means they cannot collect compensation for getting shot or killed by the opponent. Either way the Americans shouldn't get anything.

I don't have a hell of a big problem with the $101/2 million although the amount may be a little steep. I think he's probably had a pretty shitty life up until now, which I think very few people have all the details of. The guy has the potential of another 60 years.......the first 30 are pretty much a write off, but maybe something can be salvaged out of the remaining years however many they will number. Best just to cut the losses now.

$10.5 million, what's done is done.. the Gov't made it's choice and handed him the money.. I'm not so mad about that as I am the a Ontario Judge that blocked a Judgement that was already won against Omar from the family of the deceased medic. That is what pisses me off the most.

It was an erroneous judgement. You do not get compensation for acts during war or while committing crimes. The Americans were doing one or the other. Either way no compensation should be forthcoming to any American.
