No not confusion here at all, I was simply trying to point out that if we decide ..differentiate between one behavior and another....we must be very sure that the nuance, the conceptual fabric of those kinds of decisions are understood...by for instance young folk attending Universities and Technical Schools in Virginia...or Colorado...or Taber.....

Do we assess the character of the individual before or after we make a determination regarding the expediency and efficiency of waiving the law because of age or possible mental impairment...

Consider what is said in the article. This old guy didn't stalk from room to room with assorted weapons after a long drawn out planning stage. There was no ten minute martial arts clinic resulting in some ultra dramatic Quentin Tarantino ending. One old man pushed another old man and he fell and hit his head on something. I don't see that as remotely the same and so the response must be different. The cop who was there, that got all the information, which is his job that he has been trained for, figured that there was no point in taking this to trial, probably due to the lack of supporting evidence to find criminal negligence with intent to harm and that the stress of a trial that was doomed to fail would result in the demise of the second old man.

There can be an inquiry if the public demand it and so if it is warranted, take it up with the ministry of justice.

Yes, prison and trial would be a bitch. But if he is not fit to stand trial due to mental incompetency, he should be placed in an institution for the rest of his life. This idea that insanity is a get out of jail free card is a serious problem in our society. This guy is now free to kill someone else.

Apparently you can be too old to be prosecuted, or you can be too young. A 17-year old teen killed a Port Coquitlam man and only got 6 years in jail. The teen has been arrested 10 times in the past and he was still out on the streets.

I am assuming from the story that the mental capacity of both men was 'something' other than normal. I guess we should know that fact before we make a judgement, as it might have been
a 'just' decision. There is no point in finding blame and giving punishment, just to satisfy the public,
or anyone for that matter.

So far you have the word of the 69 year old man saying "it was self defense, and a minor act of self defense at that". And opposing him..well, you got nothing since dead men tell no tales.

And you know what? It could have been self defense. If the 69 year old had been pushed over he could have been the dead one.
