Tesla must face lawsuit claiming racism at California factory

A federal judge rejected Tesla Inc’s effort to dismiss claims by two former workers that the California electric car factory where they worked was a hotbed of racial hostility, clearing the way for a possible trial.
In a decision on Monday, U.S. District Judge William Orrick in San Francisco found open questions over whether Owen Diaz and his son Demetric Di-az faced “severe and pervasive racial harassment” in 2015 and 2016 at Tesla’s factory in suburban Fremont, which employs more than 10,000 people.
The plaintiffs, who are black, said they were subjected to repeated racial epithets dozens of times, as well as racist cartoons, and that supervisors engaged in or did little to stop the racism.
Orrick said Diaz could pursue claims that Tesla allowed and did not take reasonable steps to stop racial harassment.
He said punitive damages might be available if Tesla must have known about the harassment and “ratified” it, even if only lower level workers were directly involved.
“The n-word is perhaps the most offensive and inflammatory racial slur in English, a word expressive of racial hatred and bigotry,” Orrick wrote. “This case will proceed to trial.”
A trial is scheduled for May 11, 2020.
Tesla and its lawyers did not immediately respond to requests for comment.
The Palo Alto, Calif.-based company has faced multiple racial harassment lawsuits, but is not the only automaker to face such claims in recent years.
In 2017, Ford Motor Co agreed to pay up to US$10.1 million to settle a federal probe into alleged harassment at two Chicago plants.
Tesla has in court papers said it “did not hesitate” to address racial abuse at the Fremont factory, and there was no proof of “oppression, malice, or fraud.”
Orrick also said Diaz could pursue claims against a staffing agency that assigned him to the factory, and a liaison between Tesla and that agency.
Lawrence Organ, the plaintiffs’ lawyer, said his clients are seeking damages “in the millions” of dollars.
“Tesla is not sending a message that this kind of conduct in the workplace is not permitted,” he said in an interview.
Owen Diaz said he worked at Tesla for 11 months as an elevator operator, while Demetric Di-az spent two months as a production associate.
Allegations included a claim that Diaz’s supervisor admitted to drawing a cartoon of “a black face person with a bone in his hair” and captioned “booo,” supposedly short for “jigaboo.”
“You people can’t take a joke,” Diaz said the supervisor told him.

'NSFW': Elon Musk dances awkwardly at Tesla event in China

SHANGHAI — Elon Musk raised an online storm by dancing on stage at the launch of Tesla’s Model Y electric sports utility vehicle program on Tuesday in its new Shanghai factory, where the company delivered its first cars built outside the United States to the public.
The $2 billion Tesla Inc factory started delivering cars in just 357 days, a record for global automakers in China. The first 10 customers from the public received their China-made Model 3 sedans on Tuesday.
Billionaire CEO Musk danced enthusiastically on stage at the event, then stripped off his jacket and flung it aside to reveal a T-shirt with a cartoon of the factory. In a tweet, he labelled the video “NSFW” – not safe for work.
He predicted that “ultimately Tesla Model Y will have more demand than probably all the other cars of Tesla combined,” with his voice cracking with emotion at times while talking about the progress of the Shanghai factory.
Musk’s tweet of him dancing was viewed 2.5 million times and drew unflattering comparisons to famous Silicon Valley footage of Microsoft chiefs Bill Gates and Steve Ballmer dancing awkwardly at a 1990s Windows launch.
“Admit it Elon, you did it for the memes,” one user tweeted, along with a picture of Musk stripping off his jacket. “I see you learned your dance moves at Dad school,” said another.
“Just tryin to grow my follower count on pornhub …,” the billionaire, who has a history of being playful with his Twitter account, retorted.
The ceremony was attended by Shanghai Mayor Ying Yong and other senior government officials.
Tesla executives, however, did not provide further details on the progress of the China-made Model Y project. A Tesla representative declined to comment further.
Tesla’s shares, which have jumped about 10% since the beginning of this year, are trading close to their record high after the company beat Wall Street estimates for vehicle deliveries in its fourth quarter.
The positive news from the China factory have also caused a rally in shares of Tesla’s Chinese suppliers. Shares of Tianjin Motor Dies Co Ltd have surged about 28% so far in 2020, while VT Industrial Technology Co Ltd is up nearly 6%.
Construction of Tesla’s first plant outside the United States began in January 2019 and production started in October.
The factory started with a production capacity of 150,000 Model 3 sedans and Tesla aims to push that to 250,000 vehicles a year, including Model Y, in the plant’s first phase.
Tesla unveiled its Model Y in March 2019 and said in October that production of the electric compact SUV at its Fremont facility was running ahead of schedule, adding at the time that it expects to launch the model by summer 2020.
It has said that margin expectations are higher for Model Y than Model 3, while production costs are roughly the same.
Tesla’s China website estimates the starting price for Model Y vehicles at 444,000 yuan ($83,026.89). It will announce the retail price later, the website says. The China-made Model 3 sedans are priced at 355,800 yuan before subsidies.
Shanghai Vice Mayor Wu Qing said he hoped to see Tesla extend its cooperation with the city and for the car maker to manufacture more models at its Chinese plant.

Canadian musician Grimes is reportedly pregnant with her first child after sharing an arty image of herself “knocked up.”
The Oblivion singer, born Claire Elise Boucher, tested Instagram censors on Wednesday by posting a topless photo of herself displaying her growing belly, which was depicted as translucent, showing the image of a fetus in her stomach.
There was no caption beside the snap, leaving fans wondering if Grimes was using the picture to announce her pregnancy or if it was just art linked to her upcoming album, Miss Anthropocene.
However, the star, who has been dating Tesla co-founder Elon Musk, appeared to confirm she was actually with child after one follower applauded her decision not to blur out her breasts in the shot.
“Love how you don’t even censor the nipples,” the fan wrote, to which Grimes replied, “I thought about censoring them for a hot minute haha (this may get taken down anyway), but the photo is so much less feral without the nipples.”

“Plus being knocked up is a very feral and war-like state of being,” she added. “Might as well be what it is…”
The 31-year-old went public with her romance with Musk, 48, in May 2018 as they hit the red carpet together at the Met Gala in New York.
They were most recently spotted attending the Kardashian/Jenner family’s annual Christmas Eve party, held at Kourtney Kardashian’s Los Angeles home.
Representatives for the pair have yet to comment on the baby reports.
Musk is already a father-of-five from his first marriage to Canadian author Justine Wilson, whom he divorced in 2008 after eight years of marriage.
