No, common sense is rarely applied because common sense is not the law in Canada. Any Justice who would impose common sense judgements, notwithstanding contradictory legislation, should be removed from that case and, in exceptional circumstances, the Court.

I guess you are right Judicial Decisions should Never Be Founded on Common Sense.

Otherwise we would not need lawyers and then what would we do with all the lawyers?

Can't have lawyers pandering their trade for a dime a dozen, since anyone can use common sense to make decisions and it does not require any legal training to apply common sense which everyone has by the age of 6 and can see the difference between right and wrong.

Need them lawyers and judges working hand in hand to keep everyone guessing right from wrong depending on how the arguments go.

Law founded on bullshit that goes either way without any common sense everyone can understand.
