Ontario’s ombudsman says that with police co-operation being “the exception, not the norm,” the provincial government should consider implementing rarely-used powers to “direct police on how to do their job” in the aftermath of last weekend’s shooting death of teenager Sammy Yatim.

“What we saw on the [streetcar] is not something that is completely unfamiliar with the Toronto Police Service. There have been literally dozens of inquests that have recommended measures to de-escalate this kind of conflict,” Andre Marin said in a blunt interview with the CBC’s Metro Morning Wednesday.

He suggested if police can’t or won’t implement better training protocol, it might be time for the province as “Bigger Brother to take charge and direct police on how to do their job.”

“We are talking about life and death here. We are talking an 18-year-old on a [streetcar] by himself. Nine bullets and according to reports, Tasered following that.”

Marin said he was “shocked” by the incident and is closely watching the Special Investigation Unit’s probe into the death of Yatim, who was shot multiple times on an empty streetcar by Toronto Police Const. James Forcillo last Saturday morning.

Forcillo called for a Taser to be taken to the scene, a source told the National Post, believing the situation “could be contained” to the streetcar. However by the time a Taser arrived on scene, Yatim was already lying on his back, hit with multiple bullets

Marin, a former head of the SIU, said while he appreciates Toronto Police Chief Bill Blair’s promise to co-operate with the SIU investigation and to help find answers to the public’s questions, historically that has not been the case.

“The co-operation with the police in an SIU investigation is the exception, not the norm,” he said.

Many Torontonians are outraged by the incident, which was captured by at least three cameras that have so far been made public.

Combining two of the videos, one from a witness’ camera and a second from a nearby security camera at the corner of Dundas Street West and Bellwoods Avenue, Yatim can clearly be seen lying on his back in the streetcar, already shot, when six more shots are heard. About 30 seconds after that, a Taser is heard being deployed

Const. Forcillo has been suspended with pay, as is protocol by provincial law. According to Ontario’s “Sunshine List,” the six-year veteran was paid about $106,000 in 2012. The base pay rate for a 1st Class Constable is $86,365.94, according to Toronto Police.

His lawyer, Peter Brauti, told The Canadian Press he is reviewing the case and has not decided whether to recommend Forcillo submit to a SIU interview.

Police officers subject to a SIU investigation can legally refuse an interview or to turn over their notes. Witness officers, of which there are 22 in this case, must submit to an interview with the SIU.

In video taken in the immediate aftermath of shooting, a plainclothes police officer in blue jeans and a black T-shirt, arrives and speaks briefly with two bicycle cops.

Footage of Saturday’s fatal shooting shows Yatim clearly gesturing toward police with a knife in his hand. There is audio of someone saying: “You’re a *****. You’re a f——- *****”, while police yell “Drop the knife” repeatedly.

Yatim then backs off behind the driver’s well, toward the first row of seats.

Audio made available to the National Post from video taken from a different angle showed this to be the moment when a male police officer appears to say: “If you take one step in this direction with that foot …[inaudible] die.”

The first shots come five seconds later.

“Where is he? Where’s Forcillo?” he says. “Hey! Find me Forcillo. Where’s Forcillo?”

“Right here,” says a voice offscreen and the plainclothes officer walks away.

The same video shows a chaotic aftermath to the shooting, with shell casings lying on the road and under a parked car. While some officers tiptoe around the casings, the person taking the video notices at least one casing being kicked by an officer.

Nothing sarcastic nor outlandish, just the cold hard reality!! It's just too bad you (and a few others here) have been pampered all your lives and you can't face reality!!

Oh well, I guess we realists just have to keep carrying more than our fair share of the weight to keep this country safe and strong,*sigh* !!
