A police officer can also arrest a foreign national within Canada, accuse him of having violated the Immigration and Refugee Protection Act, and then transfer him to CBSA Inland Enforcement along with a false police statement. The CBSA can then bring him before the Immigration Board where he will be tried under an adversarial system (meaning that the Minister's counsel essentially serves as the gatekeeper to the available evidence and is paid expressly to prove guilt) and on a mere balance of probabilities to decide whether he can remain in Canada.

The system is essentially rigged. To be found guilty of having violated IRPA, one should be tried at least in an inquisitorial hearing and preferably on the presumption that he is innocent until proved guilty beyond reasonable doubt. If we want to broaden the restrictions on foreigners' rights in Canada, by all means. But let's ensure they have a right to a truly fair trial.
