Trial for man accused of York University webcam murder starts this week

TORONTO - Her parents will make the long journey from China to seek justice for their slain daughter.
Three years after 23-year-old student Qian “Necole” Liu was killed in what has been dubbed the Webcam Murder, the trial is finally slated to begin this week with jury selection at the downtown Toronto courthouse.
“They will be attending,” confirmed friend Charles Burton, a former Canadian diplomat to China who has worked with Liu’s father, Liu Jainhui, in Beijing. “I think they’re hoping the Canadian justice system will produce a just result.
“They have a language barrier and they don’t understand our system all that well, but they will have an interpreter at the trial,” added Burton, a political science professor at Brock University.
It was a slaying ripped from the script of a terrifying TV drama.
Liu, a graduate of Beijing City College, came to Toronto in September 2010 to study English at York University. She rented a unit in one of the red brick townhomes south of the university popular with students.
But, Liu missed home and told her mother that during their final web chat just hours before she was killed April 15, 2011.
Her next web call to Beijing was with Meng Xianchao, her boyfriend of seven years. It was around 1 a.m. and the petite visa student was in her basement unit on Aldwinckle Heights when police say she got a knock on the door.
Toronto Police homicide detectives have said Liu didn’t have a peephole, so she would have had to open the door to see who was there.
Her boyfriend watched in horror at what then transpired.
“I was so far away. I couldn’t reach her,” he told a reporter in Beijing. “I felt helpless and couldn’t calm down.”
From 18,000 kilometres away, all he could do was frantically try and reach his Toronto friends and ask them to check on Liu. But people were sleeping and it wasn’t until around 11 a.m. that two friends were let into her apartment by her landlord to see if she was okay.
But, it was too late. They discovered Liu’s body, naked from the waist down. Police would later say there was no obvious sign of trauma or sexual assault.
Her cause of death has not been released.
The bizarre murder made headlines around the world. At a press conference, Det.-Sgt. Frank Skubic said there appeared to be no recording of the webcam transmission of Liu’s fatal encounter and said police were seeking her missing webcam, IBM ThinkPad laptop and Nokia smartphone, all assumed to have been taken after she was killed.
Five days after the murder, police had a suspect under arrest. Charged with first-degree murder is Brian ****son, a handsome, 29-year-old former York U. global politics student who lived in the same building. The university was quick to issue a press release to say the running instructor and amateur actor was no longer registered at York and had never graduated.
For Liu’s parents, there are so many questions they need answered. But, the wheels of justice move slowly and the original trial date they were given was postponed for a year.
“It’s been a very long delay,” said Burton, who’s known the victim’s father, a Communist Party historian, since 2006. “It really is disturbing to have it drag out so long.”
Liu’s parents are trying to prepare themselves not only for the horrible details of their daughter’s death, but also for the intense media interest this trial will garner. It’s made headlines internationally because of the lurid webcam aspect. In China, it will be closely watched by parents who worry about the safety of sending their children to study in Canada.
For Burton, who was once an exchange student in China, it all hits too close to home,
“I have a daughter who’s of similar age,” he said. “I feel a great deal of sadness over the whole thing. I want something done so the family will feel the matter is settled in a just way.”

That poor girl and her family. I hope justice is served properly and the murderer gets what is coming to him.

Also, I cannot imagine what the boyfriend is going through. Witnessing your girlfriend's murder (or at least parts of it) is something that would haunt you for the rest of your life.:(

Accused killer Brian ****son has pleaded guilty to manslaughter in the April 15 slaying of York University student.
The plea was rejected by the Crown. ****son has pleaded not guilty to first-degree murder in the slaying of 23-year-old student Qian “Necole” Liu and jury selection will now proceed at his trial.
Liu, a graduate of Beijing City College, came to Toronto in September 2010 to study English at York University. She rented a unit in one of the red brick townhomes south of the university popular with students.

The former boyfriend of Qian “Necole” Liu listened helplessly by his computer’s webcam in Beijing as she was attacked in her North York home, a jury heard Monday. In her opening, Crown attorney Christine Pirraglia said Xian Chao Meng and Liu were engaged in an online chat, both visually through a webcam using the Tom Skype program and a MSN-style messenger service in the late hours of April 14, 2011 and into the early hours of April 15. While Meng never saw the deadly struggle — which was off camera — he heard his ex-girlfriend say “no” in both English and Mandarin to her attacker’s sexual advances, Pirraglia said.

A tenant at Qian “Necole” Liu’s home recalled Tuesday how he discovered her corpse after an urgent message tipped him off that she was “in danger.” Zhimming Zhuo said his roommate phoned him to knock on Liu’s door on the morning of April 15, 2011 after her former boyfriend messaged him, saying she was in peril. “Liu’s ex-boyfriend back in China left a message with my roommate, saying she was in danger,” testified Zhuo. Fellow tenant Brian ****son, 32, is accused of first-degree murder in the killing of Liu, 23, at her Aldwinkle Heights residence.

TORONTO - The cause of slaying victim Qian “Necole” Liu’s death cannot be determined, but it was most likely caused by neck compression, a pathologist testified at her murder trial Wednesday.
“With the pathological evidence we have, we can’t tell exactly what happened,” testified Dr. Jeff Tanguay at Brian ****son’s first-degree murder trial.
****son, 32, and a fellow tenant in Liu’s Aldwinkle Heights residence, has pleaded not guilty to murder in the death of the 23-year-old York University student. But he has pleaded guilty to manslaughter — which the prosecution rejected — but has admitted causing her death.
Tanguay performed the autopsy on Liu and found some minor injuries, bruising on her right temple area, her triceps, neck and upper back as well as pinpoint bleeding inside her eyes.
Pinpoint bleeding is a symptom of neck compressions either from choking or strangulation, heavy pressure on the chest, suffocation of airways or a combination of all three, explained Tanguay.
Liu could also have been killed by a heavier man sitting on her chest or back, a process called “burking,” Tanguay told defence lawyer Rob Nuttall.
The prosecution is asserting that Liu and her ex-boyfriend Xia Chao Meng were involved in a lengthy, online chat on Skype as well as text messaging when ****son forced his way into her basement apartment. Meng saw the initial sexual advance, but the rest of the struggle was off camera.
****son’s semen was found on Liu’s abdomen and she was found lying face down and naked from the waist down.
Nuttall asked Tanguay if Liu could have been killed by a blow to the chest — triggering a cardiac arrest — or by an underlying heart condition. He agreed it was possible. The pathologist didn’t have Liu’s medical records at the time of the post-mortem exam.
****son’s videotaped police statement started to play before the jury in the late afternoon.
Det. Sgt. Frank Skubic informed ****son that he was a “person of interest” and possibly a suspect in Liu’s “suspicious death” as he matched the assailant’s description and lived in the same dwelling.
The trial resumes Thursday.

Chao Meng will take the stand in the first-degree murder trial of Brian ****son - the man accused of killed Liu, a York University student.
Her body was found in an off-campus apartment in April 2011.

TORONTO - The so-called webcam murder trial is set to resume Monday afternoon.
Toronto's Brian ****son, 32, faces a charge of first-degree murder in the death of Qian "Necole" Liu, a 23-year-old York University student who came to
Canada from Beijing to study English.
Her half-naked body was found in her off-campus basement apartment on April 15, 2011.
It was around 1:30 that morning a man forced his way into Liu's apartment.
On Friday, the court heard from Xia Chao Meng, the 27-year-old Beijing-based ex-boyfriend Liu had been having a webcam chat with when the attack occurred.

If they don't do their job and defend with every tool and skill available to them then we will have no justice system. While I understand what you are saying its an adversarial system but it's the only thing we currently have.

TORONTO - Bruising on York University student Qian Liu’s neck and bleeding in her eyes indicate the woman was asphyxiated by neck compression, says the second pathologist to testify at the so-called webcam murder trial.
Dr. Christopher Milroy, a forensic pathologist who did a peer review of the first pathologist’s report on Liu’s death, told a jury Monday the bruising and haemorrhaging of her neck muscles and burst blood vessels in the whites of the woman’s eyes are indicative of someone who has died due to “mechanical asphyxia,” and chalked it up to neck compression.
“These are real injuries caused in life,” said Milroy.
He added some sort of ligature could have caused the compression of the neck or it could have been done “with the hands ... manual strangulation.
“Or it can be an arm lock, (where the front of the neck is held against a forearm),” he said.
Dr. Jeff Tanguay, who testified last week, couldn’t provide a definitive cause of death, but said the best explanation could be mechanical asphyxiation due to a neck or chest compression — or something blocking an airway.
Liu’s body was found — on April 15, 2011 — naked from the waist down on the floor of the basement apartment she was renting on Aldwinckle Heights.
Brian ****son, 32, who was also a tenant in the house, has been charged with first-degree murder.
Last Friday, court heard from Xia Chao Meng, the 27-year-old ex-boyfriend Liu had been having a webcam chat with when the attack occurred.
Meng said he watched in horror from his room in Beijing as Liu answered her door, had a brief conversation with a man through a crack in the door, and was suddenly grabbed and pushed to the ground and out of Meng’s webcam view.
Meng testified that the man, naked from the waist down, got up, locked the apartment’s door, and shut down Liu’s computer.

TORONTO - Alleged murderer Brian ****son will likely know his fate next week as the Crown closed its first-degree murder case against him Tuesday.
Jury members will begin their deliberations on Monday after hearing final arguments by both defence and Crown counsel on Friday, Justice Anne Molloy said. She will give her final instructions to the jury on Monday.
****son is accused of sexually assaulting and killing 23-year-old York University student Qian “Necole” Liu at her Aldwinckle Heights residence on April 15, 2011.
Before her death, she was chatting with her ex-boyfriend Xia Chao Meng in Beijing through a webcam and a Chinese version of MSN-messenger service.
Meng testified that his conversation was interrupted by a knock at Liu’s door. Meng saw the intruder to Liu’s room make a pass at her, heard her say “no” in both Mandarin and English, and then after two muffled bangs, never hearing from Liu again, court heard.
Meng saw the assailant, naked from the waist down, approach Liu’s computer and turn it off. The computer was never found and Liu was discovered dead, lying face-down and naked from the chest down in her basement apartment.
****son, 32, who was a tenant in the same house where Liu resided, has pleaded guilty to manslaughter — meaning he has taken responsibility for the killing, but denied that it was intentional. The prosecution rejected that plea.
Court heard Tuesday that DNA found on Liu’s body matched ****son’s DNA profile and that blood found on a blue T-shirt in ****son’s room matched the victim’s DNA.
Two pathologists gave evidence at the trial. The second pathologist, Dr. Christopher Milroy, testified that the bruising on Liu’s neck and bleeding in her eyes indicated she was asphyxiated by neck compression.
Milroy did a peer review of the first pathologist, Dr. Jeff Tanguay, who last week told the jury that he couldn’t give a definitive cause of death. Most likely, he added, she died by mechanical asphyxiation due to neck or chest compression — or the blocking of an airway.

Accused webcam killer Brian ****son is guilty of “despicable, disgusting and blame-worthy conduct” but not first-degree murder, his lawyer told a jury Friday during closing summations.
York University student Qian “Necole” Liu was on a webcam with her boyfriend in Beijing on an evening in April 2011 when she answered a knock on her apartment door and was dead 22 minutes later.
****son, 32, has pleaded not guilty to first-degree murder and his lawyer says he should instead be found guilty of manslaughter.
The Crown claims ****son — who is seen on the webcam and whose DNA matches semen found on the body — killed Liu after sexually assaulting her to keep the 23-year-old student silent and hide his crime.
“This could just be a sexual assault,” said defence lawyer Robert Nuttall. “I’ll go further than that and suggest manslaughter. There is not significant evidence to prove beyond a reasonable doubt that (****son) had murderous intent.”
