Justice minister denounces judge's comments on teen sexual assault victim's weight - Montreal - CBC News

I acknowledge that sexual assault is difficult to prove beyond reasonable doubt, so I don't fault the judge for that. Beyond that though, the judge should show the victim some respect unless there is strong proof that she made a false accusation. Is it so difficult for a judge to acquit the accused without insulting the alleged victim? Seriously, I thought these judges were supposed to have received a higher education than the average Canadian.

We'd better make sex a crime to fix this.

Firstly, do you know the difference between sex and fornication?

Secondly, in this particular case, the judge did find the defendant guilty, so a law making fornication a fine-able offence would have been redundant in this particular case. Given the low conviction rate though, it could prove useful in more difficult-to-prove cases as an effective deterrent given how convictions are so difficult to get for sexual assault.

Thirdly, how would a law against fornication prevent judges from making stupid comments in court?

Hey, I'm not the one who prescribes it as a cure-all.

And you seem to have failed to notice that, crime or not, the defendant didn't have sex with the victim. Did you read the article at all?

I never said that sexual intercourse is the only form of sexual assault. But in fact any form of sexual assault can be difficult to prove, even rape.

It's a lesson for other victims that try and get justice for their injuries.

My bad. The judge did find the defendant guilty. That just makes it even worse that he should then treat the alleged victim like that.
Alleged is not the right term if the defendant was found guilty.

When you consider the ignorant prejudices relating to man-on-woman sexual abuse, you can multiply that ignorance when it pertains to man-on-man, woman-on-man, and especially woman-on-woman sexual abuse.

Where do we get these people?

You mean the judges?

He also said she was voluptuous.


Guy shouldn't be on the bench if he's going to say things like that.

He should receive some remedial edumacation at the very least.

Look on the bright side. At least he didn't say "Hell, I'd hit it myself."

A Quebec court judge has withdrawn from a case after coming under fire for comments about the nature of consent and the weight of a victim of sexual assault.

Jean-Paul Braun officially removed himself in a document signed Oct. 26. He did not provide a reason for the decision.

Judge Lori Weitzman will take over the case and will hear sentencing arguments Dec. 14.

Braun faced criticism — including from the province's justice minister — for comments made while overseeing the trial of a taxi driver accused of sexually assaulting a 17-year-old passenger.

In May, Braun found taxi driver Carlo Figaro guilty of sexually assaulting the teen in 2015.

During the trial, Braun commented on the victim's appearance, saying she was "a bit overweight, but she has a pretty face."

Braun also highlighted the girl's strict religious upbringing and suggested she enjoyed getting the attention from a man who "looks good" and that she had even flirted with him.

Rivard said the girl was simply being polite and that even if she had been flirting, it didn't mean that constituted consent.
