Germany votes for 50m euro social media fines

From October, Facebook, YouTube, and other sites with more than two million users in Germany must take down posts containing hate speech or other criminal material within 24 hours.

Content that is not obviously unlawful must be assessed within seven days.

The new law is one of the toughest of its kind in the world.

Failure to comply will result in a 5m euro penalty, which could rise to 50m euros depending on the severity of the offence.

In a statement, Facebook said it shared the goal of the German government to fight hate speech.

It added: "We believe the best solutions will be found when government, civil society and industry work together and that this law as it stands now will not improve efforts to tackle this important societal problem."

German MPs voted in favour of the Netzwerkdurchsetzungsgesetz (NetzDG) law after months of deliberation, on the last legislative day before the Bundestag's summer break.

But it has already been condemned by human rights groups and industry representatives.

They claim the tight time limits are unrealistic, and will lead to accidental censorship as technology companies err on the side of caution and delete ambiguous posts to avoid paying penalties.

The law will not come into force until after the German federal elections, which will be held in September.

Justice Minister Heiko Maas singled out Facebook, which has some 30 million users in Germany, saying experience had shown that without political pressure, "the large platform operators would not fulfil their obligations" to take down illegal content.

He added that while the law "does not solve all problems", it tackles the issue of hate crimes on social media, which are "increasingly a problem in many countries".

Mr Maas, who oversaw the legislation, told the German parliament that online hate crimes had increased by almost 300% in the past few years, adding that "no one should be above the law".

The bill was drafted after several high-profile incidents of fake news and criminal hate speech being spread on social media sites in Germany.

Angela Merkel is done for. The last refuge of failed administration is to criminalize speech against it.. that's what it will come down to.

The EU is in a state of suspended collapse that will play out over period of a few years. The populist and nationalist surge will finally reconstitute Europe along the lines of moral nation states and NOT an amoral contintental union.

It won't happen at once, but will go through refits and restarts.. and utter failures of last hope free market globalists and multiculturalists like Macron. There has been a sea change and the tide has shifted irreversibly.

Merkel and her ilk sense it and are attempting to control the script, especially on social media, but it will be futile.

You pay a fee to license your car, are you saying it's wrong to license a car? I pay fees for all kinds of things.

So we agree that a fee or a fine is not a representation of a good or bad act.

The more important question is whether or not the dollar value is appropriate to act as a deterrent.

Who will decide was is hate speech and what isn't?

One person's cucumber is another person's dildo.

(Okay, I just made that up, but I think you catch my drift.)

There are probably some easy, templated offenses that will not be disputed and some others that may go to trial.

I'll bet in a few years, if one disagrees with the act of gay marriage you could be fined for saying so. Dangerous stuff imo...Orwellian.

Some faceless bureaucrat will be deciding what is or isn't hate speech?

Funny how things go around in circles, ain't it? Was a time in the U.S. you could be fined for using certain words. And we still have "obscenity" laws.

Personally, I think putting up with idiots bellowing their hate is a price worth paying for the free flow of ideas.

But we are talking about Germany here. If you had your your land destroyed, half your male population killed, and your country occupied and split up for 45 years, and you concluded unlimited free speech had a lot to do with it, you might could take a dimmer view of "free speech."

People get too concerned about this stuff.

What is removed is usually blatantly inflammatory and companies wouldn't want to risk an uproar if it isn't.
