I'm a bit surprised you didn't get it. Perhaps you're unfamiliar with Taxman v. Piscataway, 91 F.3d 1547 (3d Cir. 1996) or the long line of Supreme Court cases that says it's unConstitutional (and a violation of the Civil Rights Act of 1964).

In other words, the state's negotiator set off a bomb with the unions. And got them to thank her for it!
