Let us be clear on this. 29 states and the District of Columbia require electors to pledge that they will vote for their party's candidate. 21 do not. Two of the 21 have laws stating that the votes of "faithless electors" shall be void.
The Supreme Court has held that requiring pledges is Constitutional, but has never ruled on whether a state may punish an elector who votes against her pledge. The Supremes have said in dicta (i.e., a statement in an opinion that is not, in itself, binding) that there is an "assumed constitutional freedom of the elector under the Constitution, Art. II, § 1, to vote as he may choose."
None of the laws on punishing faithless electors or voiding their votes has ever been tested.
