My understanding is most of the legal action that has been won covered the period of time the tobacco companies suppressed the knowledge that their product was harmful. They were held accountable for that. I am not aware of successful claims by smokers who have died or become ill later as they have had full knowledge of the consequences of their actions. Of course, lawyers are bottom feeders so there may be a suit get through every now and again.
