New York (CNN) -- A grand jury in New York on Wednesday decided not to indict white police officer Daniel Pantaleo in the July choke hold death of Eric Garner, an unarmed black man, according to two law enforcement officials.

During the fatal encounter July 17 Garner raised both hands in the air and told the officers not to touch him. Seconds later, a video shows an officer behind Garner grab him in a choke hold and pull him to the sidewalk, rolling him onto his stomach.

"I can't breathe! I can't breathe!" Garner said repeatedly, his cries muffled into the pavement.

The cause of Garner's death was "compression of neck (choke hold), compression of chest and prone positioning during physical restraint by police," the medical examiner's office has said. The death was ruled a homicide.


The New York City Police Department prohibits choke holds.


Garner, 43, was pronounced dead that day. Police had suspected Garner of selling cigarettes illegally.
The death led to demonstrations around the city and came weeks before the racially charged police shooting of unarmed teen Michael Brown in Ferguson, Missouri.

Watch the video- Police stop almost on top of the armed suspect- No one with a lick of sense does that.
Stated he verbally warned the kid 3 times- 2/3 seconds later kid is dead. Really 3 warnings in that amount of time. And you believe that?
The officer is lying thru his teeth.

2. A fella is standing there with a gun in his hand.. could be pointing down.. the minute he starts to raise his gun you shoot..

Use of the choke hold is in violation of NYC police dept policy and has been so since 1993. Grand jury feels no crime was committed? Well, we'll see what happens when the family settles its $75 million lawsuit against the city. Somebody will have to pay then.

I was in a discussion on a NY forum and we compared the differences in how the government approached enforcing lawful commands in the Cliven Bundy case and in this one. The government retreated in the Nevada case but not here. Why? Because the people assembled with weapons which is what they should be doing in NY and in Ferguson.

So was Cliven Bundy but he walked away a free man with taxpayers footing the bill.

This and the Rice incident should have the cop tried. Michael Brown's case should have been acquitted. If you don't prosecute the obvious ones, people will get upset about the legitimate ones.
