Whatever makes you think war can only be declared on a nation-state?

The first war the U.S. ever engaged in was against a non-state actor. Britain engaged in many wars against non-state actors.


and who was that "non state" actor?

The Barbary Pirates. 1801-1805, then again in 1815. And in those wars, we pursued the war into the sovereign territory of states with whom we were not at war. The Hague Conventions quoted above also state (which Rosebud conveniently ignored) that in order to enjoy the benefits of neutrality, a neutral must deny the belligerents use of its territory.

Britain engaged in wars against various tribes and sub-state organisations all over the world for over 100 years.

so, the americans legally declared war against terrorism/terrorists....correct?
