Frivilousness in the courts cuts into resources.

It's about time an end was put to this type of Bullsh*t. This "turkey" should count himself damn lucky to get away with the "slap on the wrist" he received, while the family and friends endure a life time of grief and horror.

Sorry JLM but appealing a conviction is not frivolous. It is a constitutional right. Frivolous is you suing your neighbor because he won't pay for half of the fence you put up or me suing you for slandering me on this forum. Having read the back-articles I would appeal too. They have unreliable DNA and the fact he didn't meet some buddies for a burger. Hardly enough for a conviction.

Normally I might agree with you, but those of us watching local T.V. in the Okanagan got a daily dose of this case for a year or more and the evidence against him was over whelming and I think there has to be consideration for the poor parents and family of the girl. He was such a buffoon in the court and I think all of us locally have had quite enough of him "pouring more salt in the wounds". I'll take the judgment of the jury over defense lawyers any day.

Maybe you know more of the evidence, I can only go on what is on the web. 16 year old DNA is unreliable plus he admits to having sex with her. Anyway it is a constitutional right to appeal and that is not frivolous in any way. Also the law is not allowed to consider her family. Justice is to be blind and without emotion.

Don't worry about it none. Court takes a couple of hours once a month to flip through and dismiss the frivolous appeals.

Leastways that's the way it works down here. My worry is the opposite: that in zapping the frivs, they'll mistakenly dismiss a colourable claim. It's happened before, don't think it's gonna stop.

That's true, one must always keep David Milgaard and his ilk in mind, and we know there are grievous faults with the courts, one of them being no concern for the parents/family of the victim. In this case the callous nature of the defendant has to be good for a couple years regardless, but of course that could never be made to stick.

P.S. I'd like to hear Damn Grumpy's take on this one, he being a neighbour of the deceased.

I'm sympathetic, but we have too many cases of people released upon being found innocent after 10, 20, 30 years (27 in a recent Virginia case) to ignore appeals.

I think we're on the same page here. It's pretty disgusting, but it's one of the things you have to endure to be a civilised society.
