VANCOUVER, British Columbia -- A Kirkland, Wash., company will not be allowed to build a power plant near the Canadian border under a ruling by a Canadian appeals court Wednesday.

The company, Sumas Energy 2, was seeking to have a ruling by the Canadian National Energy Board overturned. The Federal Court of Appeal declined.

After the three members of the appeals court panel finished reading their decision and left the courtroom, several spectators cheered loudly and hugged each other.

Surprised a thread on this topic was not up yet.

I am glad they said no. :D

I still don't see what the problem is. It is a non-issue for this Washington company. The US is a sovereign country. If the plant is to be built on US soil, then any court decision taken outside of US borders is non-binding to US companies.

I say unless a US court rules against, Washington officials could just go ahead and build the power plant. No one can enforce Canadian rulings on US soil.

What the issue was they wanted to hook up to the Canadian power grid. They can still build it but do to location it would cost a lot more to hook up to the grid in the US than the one in Canada.

If they had won, the company would have been allowed to build an international power line that's key to the project.

They would of had to build two power lines (as law states) a much farther distance than the one power line 3 miles to connect with BC Hydro.

What was the plant going to burn? Whatever they were going to burn, where was it going to come from?

The Canadian link provided by no1important states that they would have been burning natural gas from Canada.

The proposed plant, which would burn natural gas from Canada, would have cost $400 million and generated 660 megawatts of power.
