Crimes & Punishment & Rehabilitation - Stats Can has come out with the new figure and shows that many crimes have decreased - This is based upon a base year calculation of 2006 - Let me be clear - I do not give a Tinkers Damm that they have decreased - So please do not use that straw man.
The Justice system is broken. It does work for some as we have 1st and or 2nd timers and then we have those that are career criminals where Rehab is a joke. They all are needed as each criminal commits a crime for a variety of reasons - For some it is a way of life and they will not change for a long time if ever - for others it could be drug fuelled and they need help - others are mentally ill and our prisons are full of the Mentally Ill that do not receive any treatment - So it is only a matter of time after release for these people to reoffend - That in itself is a criminal offense committed by our Govt & Society. How else could you look at it - You know that this person is a danger and will reoffend - They are mentally Ill - They need HELP -Provide it.
We have seen how the Conservatives have made Crimes & Punishment a central core of their Party Platform - utter BS - Same applies to all Federal Parties. Playing the Tough on Crime Card - last time was the Homolka case and her pardon - Well Canada was all atwitter and the Cons and others played it to no end - The PM was outraged - Yet his Party set the rules when they were revamped in 2007 - So guess what Stevie - You fuked up.
So the System need Rehab & Restructuring from the Ground Up
While certain crimes have decreased others are I am sure increasing.
We have statistics that show that aprox 5-10 % of repeat offenders commit in the 40-50 % range of crimes. Those should be targeted for special attention -longer parole and stricter terms - The Govt has the power - Just do it.
Calgary Police has a program where they identify young Gang members and contact them on an ongoing basis offering ways out of Gang Life. It has had some success
We have ethnic & low income Ghettos that are the perfect spot for fostering crime and Gang Members.
Community Outreach Coordinators - identifying those that are susceptible to recruitment by Ethnic Gangs. Coordinating with the Community Elders, the Families the Schools.
Social housing for the poor and low income - Community policing - More Police for these high crime areas.
Educational assistance for Parents that emigrated and need some more qualifications to work at their prior positions before coming to Canada - Lots of talented immigrants that cannot get that qualification - variety of reasons - Supporting their family is one.
Same would apply to any Canadian that has the necessary skill sets but needs upgrading to a trade or higher education - Yes you could even make some of it repayable - long term really low interest rate - The payoffs to Canada can be immense.
We have youth that after going thru the ringer (court system) have a better understanding of the law than most Canadians.
Gangs - targeting the leadership - Proving membership in a Gang would automatically deny that person Bail.
Gang members have routinely broken bail condition including the possession of weapons when prohibited while on bail - Back to Jail but they are set free on Bail again and again. Stop the Revolving Door
Listing of Gangs as organized criminal organizations and membership in such would increase any sentences for crimes committed. Taking down the Money Men behind these gangs
A Witness Protection Program that WORKS - What we have is a sham -
Incentives - Those that can prove a money trail and where the assets are - will be awarded a portion if the case succeeds - Then a Witness Protection Program if requested.
In case certain portions of the above would be overturned by the SCOC. Parliament with all parties should consider what they can live with in amending the laws and agreeing on what exceptions they would agree on if required to use the NWS clause. - All Party agreement - All Party agreement on the use of the NWS Clause - Does each party get what they want - No - Do we get some progress - Yes. Is everyone happy - No - Can it work - Yes - And then Publish it. Message Sent. The Do it
Repeat offenders 3rd or more - Non Violent - longer sentences - depending upon the impact of the crime and yes ID theft would be included
Rehab programs that work - many do not
Work release programs - Where a person could work outside and gain experience and improve their skills. Tax Credits to companies that participate. Including wage subsidy.
Drug Courts to be implemented in all Major Cities in Canada - They work - The US is way ahead of Canada when it comes to this. Federal Govt to assume all costs.
Help for the Mentally Ill - Also Mental Illness to become part of Medi Care and the Canada Health Act - it presently is not and left to the Provinces to do as the may - We all know how that works out.
Insite - It works in my opinion - consider the cost of 1 person with Hep C or HIV and the costs run into the hundreds of thousands of dollars. You can look at it as an investment in lowered health costs - Myself I do not care how you justify it -
The average maximum Sentence for a Major Sexual Assault child is 4 Years - This was brought to light when a Judge in PEI increased a sentence for this same offence - 4 years and if not a threat - out on parole after a max of 2/3rds of their sentence - Now is the Justice System Broken - I would say A Resounding YES
1st Offence Major Sexual Assault on a child - 10 years - Successfully complete Rehab or sentence is extended - Any chance of reoffending - No release
2nd Offence Major Sexual Assault on a child -20 years - Successfully complete Rehab or sentence is extended - Any chance of reoffending - No release - Dangerous offender Status

Lowering the BOC from 0.08 to 0.04 - Mandatory blood testing in all accidents resulting in serious injuries or where the Officer has a reasonable belief that one or more drivers were impaired. Imposing Asset Based Fines - Percentage of assets to be determined by Parliament
Impaired Drivers - Mandatory Minimum for 1st offence 90 days jail - Those that are granted serving their time on weekend would have their sentence doubled - 180 days - That would mean all vacation time and every weekend & holiday for approx 1 1/2 years - No time off for good behaviour - 90 days is 90 full days.
Impaired Driving resulting in 1 death - Mandatory Minimum sentences- 5-10 years. Imposing Asset Based Fines - Percentage of assets to be determined by Parliament -Monies collected are provided to the family of the deceased.
