A 320-lb. man who accidentally killed a donkey at a nativity scene in Spain when he sat on it as a joke is being charged by an animal rights group.
The five-month-old donkey, named Platero, reportedly suffered internal injuries and needed to be put down after the unnamed man climbed the fence of a Christmas scene in Lucena, Spain, in December 2014 and sat on it.
A police investigation was launched, then dropped. The man insisted he never put his full weight on the donkey's back.
Refugio del Burrito, a donkey rights group, has filed a private criminal case against the man. He could face a fine or even prison time if found guilty.
Lucena banned donkeys from its nativity scene this year.
