It sounds like it is a loophole in their policies but they certainly are not doing anything to fix it.

I am not a lawyer, and do not even play one in TV, but they could show up to work and then be fired per mandate (which I don't think matters anymore -- at this point covid is nothing vaxed or unvaxed) but since they returned to work they are covered.
