Alberta director of the Canadian Taxpayer Federation Derek Fildebrandt has been ordered to take down his Canadian flag by his condo board in Bowness district of Calgary

Democracy and the Canadian flag versus a miffed condominium board and their rigid rulebook.

It’s the Battle of Bowness, and one that’s left a Calgary townhouse owner refusing to remove his Maple Leaf, despite threats of escalating fines and increasingly dirty looks from a handful of long-time board members.

Derek Fildebrandt says he expected no trouble when he ordered the bath towel-sized flag, paying more than $60 for a well-made example, along with a regulation flag staff to fly the banner from his new home.

After all, there were plenty of other personal decorations visible around the Riverbend Village complex on 31 Ave. N.W., including planters and wind chimes — thus Fildebrandt assumed a neat, properly displayed show of patriotism would be welcome, too.

He assumed wrong.

He should have thoroughly read the Condo's rules and regs book - not just assumed he could put up the flag. Stupid as the rule sounds, IMHO, if it is in the book then he has no excuse.

Naaaah. The director of the Canadian Taxpayer Federation would NEVER deliberately disobey his condo regs to provoke a fight.

Funny part is I'll bet the CTF usually makes freedom of contract a fetish.

agreed...if you chose condo living, you abide by the Board rules and the Board is made up of fellow neighbours... you don't like the rules get on the Board and work to change them or move ... it's "pack" living, if one needs to do their own thing and can't give and take then a condo is not place for that individual to live

to be to buy one of those places knowing its full of condo nazis with rules upon rule.
You couldn't give me one. The other problem is they have expenses that everyone
shares and the board decides everyone pays. I think I will just stay here on the farm
and enjoy the quiet. If you put yourself out there in a condo to be abused by fools
why would you be surprised when you are abused by fools?

Condo rules are not laws. They are total BS and I would defy them to the death. I would stand in their face and say, 'Kill me and take my flag.'.

No, they are contract provisions. Don't you think a person should abide by the provisions of a contract he freely signed?

Yes. It is still not a law though and the Condo nazis would have to seek their retribution in civil court.

I don't know how it works in Canada, but most states down here they could fine him, and if he refused to pay, put a lien on his condo.

I don't know how it works in Canada, but most states down here they could fine him, and if he refused to pay, put a lien on his condo.

We have more freedoms here I guess because a lien can only be put on a property by court order.

same in Canada... the Board is composed of owners who have put the rules together based on how "everyone" wants the community run and they have the right to fine and if the individual continues to be uncooperative it can be a nasty life within the community, since condo living is a world unto it's own...best to choose wisely

Seems to me this fella coulda done any number of things. He could have asked the condo board to change the rules. He coulda gathered support from other owners. He coulda maybe compromised on the size of his flag.

But I don't see any indication he tried any of that. Looks a lot like he hung out a flag he knew was in violation of the condo rules, then when they properly held him to the terms of the contract he freely signed, rather than trying to negotiate or talk sense, he went running off to whine to the semi-literate right-wing press.

As a contractor I can Lien a property that I am doing work at by just registering that lien at the land titles office. No need to go to court to register.

The bylaws of a condominium are legal and enforcable as long as they do not contravene the CONDOMINIUM PROPERTY ACT.
