NEW YORK — New York state on Monday cleared the way for Democrats in the U.S. Congress to obtain President Donald Trump’s state tax returns, raising the possibility of fresh avenues of inquiry for lawmakers investigating his finances.
Governor Andrew Cuomo signed an amendment to a tax law that would require the commissioner of the Department of Taxation and Finance to share state income tax returns and reports when certain congressional committees request them.
“This bill gives Congress the ability to fulfill its constitutional responsibilities, strengthen our democratic system and ensure that no one is above the law,” said Cuomo, a Democrat.
Trump’s attorney Jay Sekulow responded to the law by calling it an example of “more presidential harassment.”
“We will respond to this as appropriate,” he said in a statement.
The law, effective immediately, opens a new avenue for the Democratic majority in Congress to investigate Trump’s business affairs.
New York’s state legislature has had a Democratic majority in both the House and the Senate since Democrats won control of the Senate in 2018.
U.S. congressional Democrats have pushed for the release of Trump’s tax returns since he took office.
In May, Treasury Secretary Steven Mnuchin denied the House Ways and Means committee’s request that the Internal Revenue Service turn over six years of Trump’s federal tax returns, citing his belief that the committee did not have a legitimate legislative reason for the request.
The committee sued Mnuchin and the Treasury Department last week to appeal Mnuchin’s decision.

NEW YORK/WASHINGTON — U.S. President Donald Trump violated the Constitution by blocking people whose views he disliked from his Twitter account, a federal appeals court ruled on Tuesday.
In a 3-0 decision, the 2nd U.S. Circuit Court of Appeals in Manhattan said the First Amendment forbids Trump from using Twitter’s “blocking” function to limit access to his account, which has 61.8 million followers.
“The First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise-open online dialog because they expressed views with which the official disagrees,” wrote Circuit Judge Barrington Parker, citing several Supreme Court decisions.
Kelly Laco, a spokeswoman for the U.S. Department of Justice, which argued the appeal, said: “We are disappointed with the court’s decision and are exploring possible next steps.”
The White House declined to comment. White House social media director Dan Scavino was also a defendant. Twitter had no immediate comment.
Trump has made his @RealDonaldTrump account, which he opened in 2009, a central and controversial part of his presidency, using it to promote his agenda and to attack critics.
His blocking of critics was challenged by the Knight First Amendment Institute at Columbia University, as well as seven Twitter users he had blocked.
“The decision will help ensure the integrity and vitality of digital spaces that are increasingly important to our democracy,” said Jameel Jaffer, Knight’s executive director.
Tuesday’s decision upheld a May 2018 ruling by U.S. District Judge Naomi Reice Buchwald in Manhattan, which prompted Trump to unblock some accounts.
The Justice Department had called her ruling “fundamentally misconceived,” saying Trump used Twitter to express his views, not to offer a public forum for discussion.
Parker, however, said Trump’s account bears “all the trappings of an official, state-run account” and is “one of the White House’s main vehicles for conducting official business.”
He said Trump and his aides have characterized the president’s tweets as official statements, and that even the National Archives considers them official records.
Parker also found it ironic that Trump censored speech at a time the conduct of the U.S. government and its officials is subject to intense, passionate and wide-open debate.
“This debate, as uncomfortable and as unpleasant as it frequently may be, is nonetheless a good thing,” he wrote. “We remind the litigants and the public that if the First Amendment means anything, it means that the best response to disfavored speech on matters of public concern is more speech, not less.”
The case is Knight First Amendment Institute at Columbia University et al v Trump et al, 2nd U.S. Circuit Court of Appeals, No. 18-1691.

WASHINGTON — The top U.S. House of Representatives Democrat for tax policy suggested on Tuesday that a newly minted New York law giving Congress access to President Donald Trump’s state tax returns may not be relevant to his own efforts to obtain the president’s federal records.
House Ways and Means Chairman Richard Neal, who has filed a federal lawsuit to compel the U.S. Treasury to hand over six years of Trump’s individual and business federal tax returns, told reporters that Democratic lawyers for the House are reviewing the measure that New York Governor Andrew Cuomo signed on Monday.
“We’re talking to counsel. But remember that ours is a policy issue at the federal level,” Neal said. “So far, the attorneys have been pretty clear that they don’t think that it’s applicable in the manner currently being discussed, because we are basing our request on … federal law.”

Cuomo signed an amendment to a tax law that would require the New York commissioner of the Department of Taxation and Finance to share state income tax returns and reports when requested by certain congressional committees, including Neal’s.
The state law provides a new avenue of investigation for Democrats who lead the House. It circumvents Trump’s refusal to hand over his federal tax returns to Congress and would provide information that is similar to that on federal forms. Because Trump’s personal home and the headquarters of his business are in New York, he must file state tax returns for both.
Neal’s caution about exercising the New York option has frustrated tax activists who contend that state returns could provide valuable information to House Democrats, who are investigating Trump’s compliance with U.S. tax law and any conflicts of interest posed by his business holdings.
But some House Democrats worry that seeking Trump’s state returns could complicate the federal lawsuit that Neal’s committee filed a week ago to enforce congressional subpoenas for Trump’s individual and business returns.
The Trump administration contends that Neal’s committee, despite its jurisdiction over U.S. tax policy, has no legitimate legislative purpose for reviewing Trump’s tax returns.
Representative Kevin Brady, the top Republican on Neal’s panel, accused House Democratic leaders on Tuesday of undermining Congress by authorizing committee lawsuits. He introduced a bill requiring any lawsuits to be authorized instead by the full House.

And she’s not shy about flaunting her sexuality.
“This is who I am as a person. I am very confident about who I am and people pay attention to that stuff,” Catsimatidis told the New York Post.
“So many feminists dress like a man and try and act like a man in order to succeed. To me what it really means to be a feminist is to embrace what you have.”
Indeed.
The 29-year-old grew up in a lux life as the daughter of supermarket mogul John Catsimatidis — a close pal of President Donald Trump.
But she won’t go so far as wearing a MAGA hat, claiming Trump “would be scared for my safety.”
The blond is the chairwoman of the Manhattan Republican Party and N.Y.C. regional vice-chair of the state Republican Party.

WASHINGTON — U.S. President Donald Trump retreated on Thursday from adding a contentious question on citizenship to the 2020 census, but insisted he was not giving up his fight to count how many non-citizens are in the country and ordered government agencies to mine their databases.
Trump’s plan to add the question to the census hit a roadblock two weeks ago when the U.S. Supreme Court ruled against his administration, which had said new data on citizenship would help to better enforce the Voting Rights Act, which protects minority rights.
The court ruled, in considering the litigation by challengers, that the rationale was “contrived.” Critics of the effort said asking about citizenship in the census would discriminate against racial minorities and was aimed at giving Republicans an unfair advantage in elections by lowering the number of responses from people in areas more likely to vote Democratic.
Trump, a Republican, and his supporters say it makes sense to know how many non-citizens are living in the country.
“We will utilize these vast federal databases to gain a full, complete and accurate count of the non-citizen population, including databases maintained by the Department of Homeland Security and the Social Security Administration. We have great knowledge in many of our agencies,” Trump said in remarks in the White House Rose Garden on Thursday. “We will leave no stone unturned,” he said.
Trump said he was not reversing course.
“We are not backing down on our effort to determine the citizenship status of the United States population,” he said.
But there could be more legal challenges ahead for the administration because the U.S. Constitution states that every person living in the country should be counted to determine state-by-state representation in Congress and that is done every 10 years in the Census, not by other means.
“We will vigorously challenge any attempt to leverage census data for unconstitutional redistricting methods,” said Michael Waldman, president of the Brennan Center for Justice, a law and policy institute at the NYU School of Law.
Waldman said his group would also challenge “any administration move to violate the clear and strong rules protecting the privacy of everyone’s responses, including the rules barring the use of personal census data to conduct law or immigration enforcement activities.”
IMMIGRATION POLICIES
Trump, who has made hard-line policies on immigration a feature of his presidency and his campaign for re-election in 2020, said he was ordering every government agency to provide the Department of Commerce with all requested records regarding the number of citizens and non-citizens. The U.S. Census Bureau is part of the Commerce Department.
“That information will be useful for countless purposes, as the president explained in his remarks today,” U.S. Attorney General William Barr said in a statement.
Barr cited a legal dispute on whether illegal immigrants can be included for determining apportionment of congressional districts. “Depending on the resolution of that dispute, this data may possibly prove relevant. We will be studying the issue.”
The approach announced by Trump on Thursday was similar to the one proposed by a Census Bureau official to Commerce Secretary Wilbur Ross, according to a memorandum made public by congressional Democrats in 2018. It said the costs of adding a citizenship question to the Census would be high, but using existing administrative records would not.
Opponents called Thursday’s decision a defeat for the administration, but promised they would look closely to determine the legality of Trump’s new plan to compile and use citizenship data outside of the census.

A Michigan couple who are fanatical fans of the polarizing prez decided to go with a ‘Make America Great Again’ themed wedding.
Audra Johnson and her husband Jeff of Butlerville fittingly got married on July 4.
Their big day was awash in red, white, and blue decor to fit the holiday. Bridesmaids were also dressed in America’s colours.
As for the bride, she wore traditional white before changing into another dress featuring the MAGA slogan on the front — and “Trump” on the back.
“We love our country and our president. To us, it wasn’t any different than any other themed wedding,” Audra told Fox 35.

President Trump, in a Sunday Twitter thread, called out Democratic Congresswomen, saying, “Why don’t they go back and help fix the totally broken and crime infested places from which they came.”

“So interesting to see ‘Progressive’ Democrat Congresswomen, who originally came from countries whose governments are a complete and total catastrophe, the worst, most corrupt and inept anywhere in the world (if they even have a functioning government at all), now loudly and viciously telling the people of the United States, the greatest and most powerful Nation on earth, how our government is to be run,” Trump tweeted.

“Why don’t they go back and help fix the totally broken and crime infested places from which they came,” his thread continued. “Then come back and show us how it is done. These places need your help badly, you can’t leave fast enough. I’m sure that Nancy Pelosi would be very happy to quickly work out free travel arrangements!”
