WASHINGTON (CP) - Canada is jumping into a garbage dispute with the United States, much to the relief of Toronto-area politicians who'll be sitting on a mountain of trash if Michigan follows through on threats to stop taking it.

International Trade Minister Jim Peterson is telling U.S. officials pending legislation to ban foreign trash breaks free trade rules and Canada will challenge it, raising the spectre of another fracas between two countries already at loggerheads over softwood lumber.

Peterson has already complained to U.S. Trade Representative Robert Portman, saying Michigan legislation and proposals before the U.S. Congress giving states the right to restrict foreign trash contravene the North American Free Trade Agreement and the General Agreement on Tariffs and Trade.

There's been no official response from Portman.

And in a recent letter to Toronto Mayor David Miller, Peterson said Canada will mount a legal challenge if the U.S. legislation goes through.

But Ontario municipalities should mount aggressive lobbying efforts south of the border with key U.S. legislators, he said, since a challenge would take a minimum of eight to 12 months.

"Should the state of Michigan close its border to shipments of municipal solid waste from Canada, the government would vigorously defend our rights under the NAFTA and the World Trade Organization," Peterson wrote.

Well they are paying the landfills to dump it. The landfills are a private business and its the politicians that don't like it. So what? I do not like the way US is not biding by softwood lumber deal. But thats life. Tough .

Canada and its neighbour to the south enjoy a huge degree of trade. Regular garbage has been shipped from Ontario to the U.S. for years and hazardous waste has been shipped from the U.S. to Ontario. Since it was first announced that the Keele Valley Landfill was eventually going to close, the spectre of Toronto's waste (plus Peel's and Durham's) wandering the land in search of a home has been "on the radar". I don't we should be dumping our garbage in Michigan. Then again, I don't think the US should be dumping their toxic chemical waste in Mexico either. Of course I didn't think anybody should have signed the FTA or NAFTA, and this was one of the issues that brought was up way back then. People said we were crazy to even mention such a thing...that it'd never happen.

Tell ya what, Uncle...drop out of NAFTA, quit dumping your poison in Mexico, and we'll quit dumping our poison in Michigan.

I think we shouldn't bother with this challenge to NAFTA. It's already been shown that regardless of the outcome of a NAFTA ruling that we are on our own anyway. Plus, not challenging it and just 'taking note' of the situation will give us more ammunition when we (hopefully) decide to scrap NAFTA completely. If the Canadian government would finally get a spine, they'd just go tit for tat on this one and tell the Yanks that as much as we appreciate taking their money for their toxic waste, it's not gonna happen anymore and that the decision if final... please leave the council area immediately :p Sure it would cause Toronto to pile knee deep in trash but it seems it's come to that to get people to reduce their consumption.

It might not be a bad idea for Ontarioans to take responsibility for their own garbage,for various government levels demand that manufacturers change their packaging strategies,for municipalities to invest in some of the newer waste management techniques.
Why SHOULD anyone else be responsible for our garbage?

Personally, I think it's wrong to export garbage. BUT: it's perfectly acceptable under NAFTA rules, so there you go. Since under NAFTA it's acceptable, then I think we need to do it.

I cannot fathom why Toronto is so totally incompetent that they can't deal with their own garbage, but that's typical of Toronto. Hell, they can't even deal with snow.

Does Michigan ship hazardous waste to Canada?
It seems waste is a two-way street between Canada and the USA.
Hopwever Toronto should be burning their waste in efficient plants to produce electricity. Clean plants if such an item exists.

According to the Michigan Department of Environmental Quality (DEQ), in 2002 Michigan shipped 45,000 tons of hazardous waste to Canada. However, in 2003, Michigan exports to Canada decreased by 38% to fewer than 28,000 tons. This number is dwarfed by the over 9.4 million cubic yards of waste Michigan received from Canada in 2003 alone.

State officials randomly check trucks coming through customs. In 2000, 17,105 tons of hazardous waste came into Michigan from Canada, while 60,112 tons left Michigan for disposal in Canada, according to DEQ. Statistics on nonhazardous waste were not available

After reading Mark Overberg's letter regarding Toronto's municipal waste shipments to Michigan, I felt the need to bring some less known facts to light. There has been much attention given to the fact that Toronto sends household garbage to Michigan for disposal. What has not been given much attention is that Michigan sends nine times that amount of hazardous waste to Canada for disposal.

With this huge imbalance, both in volume and environmental impact, you might think that it would be us Canadians doing all the complaining. Not so, however, as Overberg joins Michigan lawmakers and congressmen who have been trying to put forth legislation banning our waste from crossing the border.

Michigan also collects fees from other states in exchange for receiving their hazardous waste shipments, and then simply sends it off to Canada for disposal. How can Michigan's citizens and lawmakers not be aware of these discrepancies?
