If he owned it, he's free to burn it (fire codes may apply).

That was the specific issue in Texas v. Johnson, 491 U.S. 397 (1989). During a protest, Johnson stole an American flag from a bank building and burned it.

So the geniuses in Texas prosecuted him for burning the flag, and never bothered to prosecute him for stealing it.

The Supreme Court held that it was protected free speech.
