Strict conditions will keep accused away from alleged victim, school

In all, four young men were charged with sexual assault and forcible confinement, 10 were charged with criminal harassment and two women were charged with uttering threats against the victim to a third party.

Yesterday, plainclothes officers stepped up their efforts and went to the school where they arrested two female students and 12 male students — two of whom are adults. Students were led away in handcuffs and taken to 31 Division where they were in custody last night. The males were charged with criminal harassment; the two females with threatening bodily harm. While the names of the accused youths cannot be released, police have not identified the two adults.


Tried by the Police and Media.

1.Arrested the kids in school and marched them through the hallways in handcuffs.
2. Fingerprinted and mug shots taken.
3. Kept in cells overnight for effect.
4. Bail hearing which is really a sort of formal posting of the rules determined by a court official. The accused has no input.
5. The next court appearance will be set Nov 25.
6. The parents will get a lawyer for about a grand each. Who will more than likely be useless.
7. Most of the charges will be dropped,since there will be no evidence except a verbal accusation.
8. Those found not fuilty or charges dismissed will have their arrest record forever. It cannot be removed from the police files.

You are guilty when arrested to some degree.

The Police who arbritarily arrested the teens will never be brought to justice for the jack boot actions. This type of justice is practiced in Canada daily. Arrested with no evidence , incarcerated,etc, and charges dropped and the police are never held accountable. Often maximium media exposure literally implying guilt ensues.

Such is the system. Arrest and Charge and let the accused be dragged through the court system. The accused is supposed to be thankful the charges were dropped as if more often than not the case. This is in spite of The Canadian Constitution.

I see from the press that the accused were back in court an no trial date set. To re-appear on Jan 16. This will go on several times, until a court date is set sometime next year or 2007. The police will have no evidence and the cases will be stayed. I think that is the legal term.

This is the procedure. Those accused are being punished by the legal system. After the cases are dropped, when a crown has time to see the evidence, which is hearsay and accusation, which will never stand close scrutiny by a defence lawyer before a judge. The accused will be freed, and the Police who laid the charges will laugh and smile with absolutely no repruscussions.

The family of the people charged have no money to hire a high priced law firm to go before the courts to sue the police.

This type of procedure is practiced daily by our police. Margaret Trudeau just won a case when the police used the same procedure of arresting withour just cause, and not allowing her to contact a lawyer, also confining here in a holding room at their leisure.

Usually the police try to keep a person in jail ovenight, since it is a sort of punishment, and they have 24 hours to bring before a judge for a court bail hearing. There is often no evidence but the courts by the procedure put an accused through hell and the arresting office gets off scot-free with laying the charge with no evidence in most cases. This is how the Canadian Justice System functions.

There no acceptable police redress procedure for an accused who is mistreated to get any sort of justice. Smile and think the justice works in Canada, until it happens to you. It takes big money to sue.
