Russell Kirkpatrick, the violent predator who beat and sexually assaulted a woman tending her mother’s grave four years ago, has been declared a dangerous offender.
Muttering and objecting throughout the lengthy decision by Justice John McMahon, Kirkpatrick, 48, was handed an indeterminate sentence with no statutory release date Wednesday. He can apply for full parole seven years after the date of his last offence — July 2010 — and then every two years thereafter.
McMahon agreed with two forensic psychiatric reports that found Kirkpatrick suffers from a personality disorder with anti-social traits, alcohol abuse disorder and paraphilia disorder — a preference for coercive, non-consenting sex — and that he remains a high risk to reoffend violently, sexually or both.
