Today, over 70 men with a large group of women escorted out a man who attempted to rape a woman here at the Oceti Sakowin camp.
Earlier in the day this issue was brought to the attention of the Oceti Sakowin headsman council, akicita okodakiciyapi and winyan okodakiciyapi (womens council) and they were asked to respond.
Concerned parties wanted to know the camp's protocol for traditional justice and what steps we would take. We decided that the perpetrator needed to be found, brought before the Akicita society, told of his charges, allowed to talk, have someone speak on his behalf and then, after deciding his case, publicly shamed by walking him out of camp. Over 100 people followed him on the long walk out of camp as we publicly announced his name and crime for all to hear.
We walked him to the Cannon Ball river bridge south of camp and once there our men handed him over to the women who held him down and cut off his braids. After which we let him go as he walked south on Hwy 1806 where we told BIA police to come pick him up.
This is restorative justice for our community. We led with Woiyukcan (purposeful thought) and then followed with Wocekiye (prayer) and ended with action. We want to send a message that such behaviour will not be tolerated by anyone. It was powerful really.
Honestly...I could have chosen not to post. I could have chosen to keep this event silent. But what would that have served? These perpetrators need to be corrected & the women be made to feel safe, not ashamed to speak up, and allowed to heal.

Sentencing Circles are a norm in the Canadian justice system. How 1980s of you Clitford.

A sentencing circle is an added step available in sentencing hearing process that are availble to aboriginal offenders. At a point before the sentencing hearing a ceremony is held where the offender meets with the victims of the offences, community representatives, including elders, and members of the justice system, including the crown and defence counsel, sometimes the judge. The offender will be required to listen to each member's views on the offender and offence. The members of the circle will then collectively come to a conclusion as to a fit and proper sentence that will ultimately be considered by the judge sitting in court at a sentencing hearing.

Sentencing circles are given no mention in the Criminal Code. The authority to order a sentencing comes from the judge's power of the sentencing hearing. [1]

The power over sentencing however stays with the judge at all times and can chose to not follow the recommendation of the circle.

And here's me thinking I would have just beat his a$$ into intensive care, tatooed 'rapist' on his forehead and then had him jailed in general population....but cutting his hair and walking him out of camp was so much more punishment.

There was no court order. They were asked to voluntarily stop construction. They voluntarily said no.

I ask tough questions of myself - which I don't hear being asked here. (and cannot fathom why not?) Questions like: what am I missing? Many of the people celebrating the sudden change in direction are people I like and admire - intrinsic shared values between us still exists for me, why doesn't it for them anymore?

How can we empower them enough to take away the fear that drives their hate? I'm looking - everywhere -(f*ck, even here!) and I cannot seem to find anyone who supports this kind of thinking and behaviour willing to hear anyone but themselves - with no comprehension of how dangerous it may be for them or someone they truly love at some point, if they don't elevate their vision above their own immediate wants.

Ya PN - it matters to me even why you - who clearly sees something wrong with violating women physically - cannot understand that there are so many ingrained ways to violate a woman - you don't even have to physically touch her to do it, and you are doing it with sad regularity here.

I should have approached you in a much more open way to try and have this discussion, but I admit, I do feel like a prickly b*tch these days - it's hard to open oneself - be vulnerable - yet again, to this without approaching with one's own sword drawn. If I thought there was an opportunity to reach anyone here with an open heart instead of a harsh knee jerk post, I might have thought to try that.

I honestly didn't read much past the third paragraph. I don't come here to read books. I imagine it is the same drivel as before...'blah blah blah I don't hate men blah blah'... I'm sure there are men you put up with and even a few who agree with you totally that you like but you are a misandrist, no doubt about it. While I am just not PC and having a laugh your hatred is quite real and obvious.
