Trump must pay US$2M for misusing namesake charity: Manhattan judge

NEW YORK — A New York state judge on Thursday ordered U.S. President Donald Trump to pay US$2 million for misusing his namesake charitable foundation, resulting in funds being used to advance his 2016 presidential campaign.
Justice Saliann Scarpulla, of the state Supreme Court in Manhattan, directed the payment to eight non-profits, in connection with a lawsuit by the state’s attorney general against the president and three of his adult children over the now-dissolved Donald J. Trump Foundation.
President Trump defended the charity in a statement on Twitter, saying the foundation was an “incredibly effective philanthropy” that had made “some small technical violations.”
A spokesman for the Trump Foundation said it was pleased the court rejected the attorney general’s request for punitive damages.
The attorney general, Letitia James, said her office had also reached agreements with the foundation and its directors to end the June 2018 lawsuit, which was filed by her predecessor, Barbara Underwood.
James said Trump admitted to “personally misusing funds at the Trump Foundation,” which agreed last December to dissolve, and accepted limits on his activities if he created a new charity. James also said Trump’s children – Donald Jr., Eric and Ivanka – agreed to “mandatory training” on the duties of charity officials.
“The court’s decision, together with the settlements we negotiated, are a major victory in our efforts to protect charitable assets and hold accountable those who would abuse charities for personal gain,” James said in a statement.
Trump, in his statement, accused James of “deliberately mischaracterizing this settlement for political purposes.”
Underwood had filed suit after a 21-month probe that she said uncovered “extensive unlawful political coordination” between the Trump Foundation and Trump’s campaign. The lawsuit sought to recoup $2.82 million donated to the foundation in a 2016 Iowa fundraiser for military veterans, but which Underwood said Trump allowed his campaign to control.
Scarpulla agreed with the attorney general’s office that Trump had breached his fiduciary duty to the foundation.
“Mr. Trump’s fiduciary duty breaches included allowing his campaign to orchestrate the fundraiser, allowing his campaign, instead of the Foundation, to direct distribution of the funds, and using the fundraiser and distribution of the funds to further Mr. Trump’s political campaign,” she wrote.
The judge said that because the money ultimately went to support veterans, Trump should pay just $2 million, without interest, rather than the entire $2.82 million.
In refusing to award punitive damages, Scarpulla cited Trump’s agreement to take steps to avoid a recurrence.
The $2 million is expected to go to Army Emergency Relief, the Children’s Aid Society, City Meals-on-Wheels, Give an Hour, Martha’s Table, the United Negro College Fund, the United Way of the National Capital Area and the United States Holocaust Memorial Museum.

Chinese national gets eight-month sentence for trespassing at Trump's resort

FORT LAUDERDALE — A Chinese woman was sentenced to eight months in prison in a federal court on Monday after she was convicted of bluffing her way into U.S. President Donald Trump’s Mar-a-Lago resort in Florida, sparking fears she could pose an intelligence threat.
Yujing Zhang, 33, was found guilty in September of lying to a federal officer and trespassing at the Palm Beach resort by a U.S. District Court 12-member jury in Fort Lauderdale after a two-day trial.
Zhang has already served more than seven-and-a-half months of the eight-month sentence, starting from the time of her arrest. She was also sentenced to two years of supervised release by District Court Judge Roy Altman.
“The evidence was overwhelming that Zhang lied time and time again to the Secret Service agents when she came to Mar-a-Lago,” Altman said during the sentencing hearing.
Zhang, who has maintained her innocence, made international headlines in March when she was arrested carrying multiple electronic devices at the resort.
“I came to the property and just followed the instructions and asked where to go. I don’t think I am lying,” she said in court. “I came to meet the President and family to just make friends.”
On March 30, Zhang passed an initial Secret Service checkpoint by passing herself off as a relative of a resort member of the same name and telling club security personnel she was going to the pool.
But once she gained access to the grounds her behavior, including shooting many photographs, aroused suspicion.
At one point before she was arrested, Zhang told club personnel she was there for a United Nations Chinese American Association event, which turned out to be nonexistent, federal prosecutors said.
The question of what she was doing at the club remained unanswered as prosecutors offered no explanation in court for her motives.
Zhang’s actions sparked concerns she might have been a spy. But U.S. experts told Reuters her attempt to enter the club was so clumsy that while she has been linked to the Chinese Communist Party in Beijing, it was hard to believe she was a professional spy.
In a court filing this month, Assistant U.S. Attorney Rolando Garcia asked Altman to consider an 18-month prison sentence for Zhang rather than the suggested six months in the sentencing guidelines.
Garcia wrote a stiffer penalty was warranted because of the seriousness of the crimes, the need to deter similar conduct, and because Zhang lied to another federal judge about her finances.

Trump’s critics speak with one voice in demanding accountability. Yet virtually no one has been held accountable for the pain, suffering, and loss inflicted by the architects of the Iraq War and the Great Recession. Why is that? As another presidential election approaches, the question not only goes unanswered, but unasked.
To win reelection, Trump, a corrupt con man (who jumped ship on his own bankrupt casinos, money in hand, leaving others holding the bag) will cheat and lie. Yet, in the politics of the last half-century, these do not qualify as novelties. (Indeed, apart from being the son of a sitting U.S. vice president, what made Hunter Biden worth $50Gs per month to a gas company owned by a Ukrainian oligarch? I’m curious.) That the president and his associates are engaging in a cover-up is doubtless the case. Yet another cover-up proceeds in broad daylight on a vastly larger scale. “Trump’s shambolic presidency somehow seems less unsavory,” Moyn writes, when considering the fact that his critics refuse “to admit how massively his election signified the failure of their policies, from endless war to economic inequality.” Just so.
What are the real crimes? Who are the real criminals? No matter what happens in the coming months, don’t expect the Trump impeachment proceedings to come within a country mile of addressing such questions.”

Newsweek magazine canned reporter Jessica Kwong after she wrote an article claiming U.S. President Donald Trump was “tweeting, golfing and more” on Thanksgiving.
In reality, the commander-in-chief was making a surprise visit with U.S. troops in Afghanistan.
Kwong’s article was published Thursday before details of the secret trip emerged.
Newsweek’s headline was: “How is Trump spending Thanksgiving? Tweeting, golfing and more.”

But Trump and his son, Donald Jr., lambasted the mag for the error.
Newsweek said an investigation has been launched into how the inaccurate story made its way to publication.

“The story has been corrected, and the journalist responsible has been terminated. We will continue to review our processes and, if required, take further action,” Newsweek told the Washington Examiner.
Kwong told the Examiner she had been assigned to write the story and later flagged an editor that her story needed to be updated.
Instead, another reporter was assigned to the story. The initial story was not updated.
The new headline? “How is Trump spending Thanksgiving? Tweeting, golfing – and surprising U.S. troops in Afghanistan.”
Newsweek’s updated story contained a note.
Kwong said on social media it was “an honest mistake.”
