TORONTO — An American military court has appointed three judges to hear Omar Khadr appeal his war-crimes convictions, signalling a possible end to a years-long delay in the Canadian’s quest to clear his name.
The panel appointment comes just days after a civilian court ordered the U.S. government to respond to Khadr’s latest plea to have his appeal heard.
Sam Morison, Khadr’s American lawyer, said the Department of Defence has opposed having Khadr’s case decided because it considers him a fugitive.
“It’s just irrational. How can Khadr be a fugitive? They transferred him to Canada,” Morison said on Wednesday from Virginia. “They know that their case is vulnerable (and) they’re trying any way they can to avoid having to confront the merits of his appeal”
Since the Americans returned him to Canada in September 2012, the Toronto-born Khadr has been trying to clear his name. He filed an appeal of his convictions in November 2013.
American soldiers had captured Khadr as a badly wounded 15-year-old following a firefight in Afghanistan in July 2002 in which a U.S. special forces soldier was killed. He was moved to the notorious U.S. military facility at Guantanamo Bay within months.
In October 2010, Khadr pleaded guilty to five purported war crimes before a widely maligned U.S. military commission and was sentenced to eight more years in prison. He later said he pleaded guilty as his only way out of Guantanamo Bay.
Khadr’s appeal argument — with some support from U.S. courts — is that the commission convicted him of offences that weren’t crimes at the time he allegedly committed them. However, the U.S. Court of Military Commission Review that sits as a first appeal forum for commission verdicts has steadfastly refused to hear his case.
That precludes Khadr, who turned 33 last week, from taking his fight to a civilian appellate court where normal rules of evidence apply.
Last month, Khadr petitioned the U.S. Court of Appeals for the District of Columbia Circuit to force the military review court known as CMCR to hear his appeal.
“The CMCR has obdurately failed to exercise its affirmative statutory obligation to review the validity of his conviction,” Morison states in the petition. “After nearly six years, the CMCR’s continued foot-dragging amounts to little more than a pocket veto of Khadr’s right to direct review, and this court’s appellate jurisdiction.”
On Friday, the D.C. Circuit Court gave the U.S. government 30 days to respond. However, the Court of Military Commission Review issued a terse order on Tuesday appointing William Pollard as presiding judge to hear the case along with Chief Judge Paulette Burton and Judge Jan Aldykiewicz.
The review court did not respond to a request for comment and it remained unclear when Khadr might finally get a hearing.
Khadr became a political flashpoint in July 2017, when the Canadian government paid him $10.5 million for violating his rights. The Supreme Court of Canada had previously ruled the government had failed him during his detention in Guantanamo Bay.
However, he remains a convicted war criminal. His conviction looms large in a civil suit by the widow of the American special forces soldier Khadr is alleged to have killed in Afghanistan and a former soldier blinded in that battle. A court in Utah awarded them US$134 million based on Khadr’s military commission confession and conviction. Their attempt to enforce the award in Canada is scheduled to continue in November.
Khadr has married and lives in Edmonton without restrictions. An Alberta court had ordered him released on bail in April 2015 pending disposition of his appeal in the U.S. but earlier this year, the court ruled he had served his sentence and released him unconditionally.

Despite what the pro-kill Khadr side claims, I doubt the truth of what happened will ever be really known. The waters have gotten so muddied since that I don't know if anything positive will happen.


It's a total clusterfuk and has been since the moment he was captured at 15. If it were a crime scene, there would be people fired over the mishandling of things, but because it was 'war', who cares.

I think as long as Omar sticks to the straight and narrow, the past should be relegated to "the past" as there is nothing that can be fixed now and I doubt very much if all his treatment at Guantanamo was proper.

TORONTO — Forcing a military court to hear and decide an appeal from former Guantanamo Bay prisoner Omar Khadr is inappropriate, the American government says.
In new legal filings, U.S. government lawyers argue the years-long delay in hearing the Canadian’s case is reasonable, and civilian court intervention unjustified.
American troops captured the Toronto-born Khadr, 33, as a badly wounded 15-year-old in Afghanistan in 2002. He pleaded guilty in 2010 to five war crimes, including the murder of U.S. special forces soldier Christopher Speer, before a widely disparaged U.S. military commission in Guantanamo Bay.
As part of the plea deal in which he gave up his right to appeal, the court sentenced him to eight more years rather than to the jury-recommended 40 years.
“Khadr waited for years after the convening authority’s action to challenge his guilty plea and appellate waiver,” the government says. “He took no action until after he had pocketed the agreement’s benefits, received his 32-year sentence reduction and transfer to Canada, and was beyond the jurisdiction of U.S. courts.”

Khadr, who later said the deal was his only way out of the infamous American prison in Cuba, filed an appeal with the U.S. Court of Military Commission Review in 2013 after arriving in Canada. He argues that the offences to which he pleaded guilty were not war crimes when he allegedly committed them.
However, the military appellate court known as the CMCR put his case on hold while civilian courts decided another commission case, that of Ali Hamza al-Bahlul. A military commission had convicted al-Bahlul in 2008 for doing media-relations work for terrorist leader Osama bin Laden, but a civilian court quashed most of his convictions in 2013.
Khadr had asked the U.S. Court of Appeals for the District of Columbia Circuit in April to order the military reviewing court to hear his appeal.
“The CMCR has obdurately failed to exercise its affirmative statutory obligation to review the validity of his conviction,” Khadr’s lawyer Sam Morison stated in the petition. “After nearly six years, the CMCR’s continued foot-dragging amounts to little more than a pocket veto of Khadr’s right to direct review, and this court’s appellate jurisdiction.”
In August, the D.C. Circuit Court ordered the U.S. government to respond.
In its response, the U.S. government argues Khadr, who has been released unconditionally and lives in Edmonton, has suffered no prejudice. It argues that putting the hearing on hold was a “reasonable measure designed to conserve the court’s and parties’ resources.”
The government also points to Khadr’s waiver of his appeal rights, and says he is asking for an “extraordinary remedy” without clear justification.

In response, Khadr’s lawyer argues the government itself has essentially admitted no legal reason exists to keep his client waiting because the al-Bahlul case has been decided.
“The government has effectively conceded that the CMCR’s abeyance orders are unlawful…and that the resulting delay violated Khadr’s indisputable right to due process in the application of his statutory right of appeal,” Morison says.
The U.S. government, however, says al-Bahlul is appealing his sentence and rejects the claim that the Khadr delay has been “indefinite.”
“What is stayed is the adjudication of the merits of Khadr’s claim that raises the same issues involved in Bahlul,” the government says.
The dispute comes ahead of a hearing on Friday in which lawyers for Speer’s relatives are expected to press a motion in Toronto that they be allowed to question him about his confession to war crimes. The motion is part of their ongoing quest to enforce a US$134-million wrongful-death award against Khadr from Utah.

TORONTO — Relatives of a slain American soldier have won a skirmish in their attempt to collect on a US$134-million wrongful-death award against former Guantanamo Bay detainee Omar Khadr.
In a pre-trial decision this week, an Ontario Superior Court ordered Khadr to answer several questions from the plaintiffs about a 50-point agreed statement of facts he signed as part of his guilty plea to five war crimes before a widely disparaged military commission in 2010.
Khadr, 33, has since disavowed the confession he says was the product of abuse. The plea deal, he argues, was his only way to be returned to Canada from the infamous American prison in Cuba.
"The plaintiffs are entitled to know which specific factual statements Mr. Khadr alleges are untrue," Linda Abrams, a court case management master, said in her decision. "To go through the statement of fact, fact-by-fact, according Mr. Khadr an opportunity to agree or disagree with specific factual statements, is not tantamount to using discovery as 'an instrument of torture.'"
A judge in Utah in 2015 made the hefty award in favour of the family of a Sgt. Christopher Speer, a U.S. special forces soldier Khadr was accused of killing in battle as a 15-year-old in Afghanistan in 2002, and Sgt. Layne Morris, another American soldier blinded in one eye by shrapnel.
Khadr, who was in prison in Canada at the time of the default judgment, offered no defence to the lawsuit. He maintains his failure to respond was because he had been denied "natural justice." He says he would not have been allowed to enter the United States and that he simply had no money to hire a lawyer to defend him in Utah.
In her decision, Abrams said Khadr will have to answer several questions about his non-defence, including whether he tried to find a lawyer and if he was in fact broke.
The plaintiffs "are entitled to test his plea of total impecuniosity which, here, he has used as a shield," the master said.
The plaintiffs should also be able to test his claim that he had no way to appear before the Utah court, either in person or via a lawyer, and how he came to be of that view, Abrams said. Khadr had conceded he had lawyers in Canada and the U.S. working for him, she noted.
The decision can be appealed but Khadr's Edmonton-based lawyer Nate Whitling had no comment on Wednesday. Jamie Schacter, co-counsel for the Utah plaintiffs, praised the ruling.
"We are looking forward to having Mr. Khadr complete his examination for discovery and answer our questions," Schacter said in an email. "We continue to move ahead and believe we have taken another step toward having our court enforce the Utah judgment."
Essentially, the plaintiffs argue Khadr can't avoid the Utah civil judgment by recanting his Guantanamo confession and guilty plea. They argue Canadian courts are bound to accept the stipulation of fact and enforce the award.
For his part, Khadr's main defence is that it would be contrary to Canadian public policy and an affront to the concept of justice to enforce the judgment in Canada since it is the "direct product of an unfair and abusive detention, interrogation and prosecution system."
In 2017, the Canadian government apologized to Khadr and paid him $10.5-million for having violated his rights while he was in Guantanamo Bay. Khadr has also spent more than six years trying to appeal his conviction but a military commission appellate court has so far refused to hear the case.
