I think that applies to cops everywhere. Egotistical people just for that reason should never be qualified to be a cop. Add a little cruelty to the egotism and you have a real A$$HOLE!

Yatim’s family sues Toronto police in wake of teen’s shooting death: report



The family of the 18-year-old shot and killed on a TTC streetcar last summer has filed a multi-million dollar lawsuit against Toronto Police, according to a published report.

The Toronto Star reports Sammy Yatim’s mother and sister filed the lawsuit in February.

The suit alleges the police officers on the scene when Yatim was shot were not properly trained to deal with someone suffering an emotional disturbance and used excessive force.

The lawsuit names Const. James Forcillo — who has been charged with second-degree murder in Yatim’s death — as well as police Chief Bill Blair, the Toronto Police Services Board, and two unnamed police officers, including the officer who Tasered Yatim after he was shot eight times.

Yatim’s family is suing for more than $8-million and claim they are suffering anxiety, depression, and physical and psychological conditions.

The defendants have not filed any statements of defense.

The family is being represented by prominent Toronto lawyer Julian Falconer who has represented other families of people killed at the hands of police, including Ashley Smith and Douglas Minty.

Yatim died July 27, 2013, after police shot the teen on an empty streetcar. He was suffering an acute emotional disturbance, the family said in its statement of claim, according to the The Star.

The system seems to have no problem laying charges , against Dangerous incompetent corrupt lying cops.

But in reality they work too close together, to ever have a conviction.

This is merely window dressing, because of the public outrage.
This guy will retire with full pension and be considered a hero before this is done.

They should do what the Chicago DA did to get Dante Servin off.

He should be charged. The kid had a knife but he was contained in an empty streetcar. No need to shoot unless he comes out and charges.
Why do you hate the police? They're brave men and women doing a tough, dangerous job. Why can't you support them? Bet if you're robbed or attacked you'll be calling on them for help quick enough.

From following this case a little I've concluded it's hard to draw a conclusion either way. Sometimes people respond to things they believe, though in many cases not very accurate. Sometimes there's three or four things happening at once or maybe the responder thinks there's three or four things happening at once.

One can not hate the police and recognize that they can occasionally be wrong.

TORONTO - Toronto Police Const. James Forcillo’s bail was extended in advance of a Nov. 9 deadline as he pursues an appeal of his conviction for the attempted murder of Sammy Yatim.
Appeal court judge Eileen Gillese, who freed Forcillo in July, asked that Forcillo surrender himself by Nov. 9 and she wanted the appeal to be heard expeditiously.
She said Forcillo poses no risk to the public “as there is no risk that he could commit further offences” and she added that the appeal wasn’t frivolous.
Defence lawyer Peter Brauti noted the bail was extended but no appeal date has yet been set.
Forcillo, 33, answered a call for a passenger carrying a weapon on a west-end Toronto streetcar on July 27, 2013.
He fired two separate volleys of shots at knife-wielding 18-year-old Yatim — the first causing critical injuries — and a second round as he lay dying and paralyzed on the floor of the evacuated Dundas St. W. streetcar.
Forcillo was acquitted of second-degree murder for the first volley but convicted of attempted murder for the second set of shots.
He received a six-year sentence in July by Justice Edward Then and Forcillo, a former court officer, spent the night in custody.
A condition of his bail is that he surrender himself on Nov. 9. His bail was extended before the previously set surrender date.
Forcillo’s bail conditions remain unchanged from the date he was charged three years ago:
A surety of $500,000.
He must remain in Ontario.
He can only leave his house once a week, and only if accompanied by someone else.

Toronto police Const. James Forcillo has had his bail extended until October, when the appeal of his attempted murder conviction is set to be heard.

Found guilty last year of attempted murder in the July 2013 shooting death of Sammy Yatim, Forcillo has been out on bail while appealing the conviction.

That appeal is scheduled to be heard Oct. 2. The officer will remain out on bail until the eve of his appeal, Forcillo’s appeal lawyer confirmed Tuesday.

Forcillo, 34, is seeking to have his conviction for the attempted murder of Yatim quashed or a new trial ordered on the charge of attempted murder only.

The officer was released under strict conditions last July, after he was sentenced to six years in prison. He spent one night in the Toronto South Detention Centre before being released on house arrest.

In her ruling granting Forcillo bail, Justice Eileen Gillese emphasized the need for the appeal to be heard as quickly as possible. In that July ruling she ordered a November surrender date for Forcillo; the officer’s bail was extended at that appearance.

The appeal was initially expected to begin this spring.

In her decision, Gillese ruled Forcillo’s incarceration pending appeal was not necessary for public confidence in the administration of justice.

“Despite the seriousness of the offence for which the Appellant stands convicted,” she wrote, “in my view, fully informed members of the community will objectively understand and accept that it is not contrary to the public interest that he be released.”

It is not unusual for offenders to be released on bail pending appeal — even for a conviction as serious as murder — if the court finds the offender is not a flight risk and poses no threat to public safety, and if there are strong grounds for appeal.

Forcillo is suspended without pay by the Toronto Police Service.
