An appeal judge in Australia has ruled that an animation depicting well-known cartoon characters engaging in sexual acts is child pornography.


The internet cartoon featured characters from the Simpsons TV series.

The central issue in the case was whether a cartoon character could depict a real person.

Judge Michael Adams decided that it could, and found a man from Sydney guilty of possessing child pornography on his computer.

The defence had argued that the fictional, animated characters were not real people, and clearly departed from the human form.

They therefore contested that the conviction for the possession of child pornography should be overturned.

Justice Michael Adams said the purpose of anti-child pornography legislation was to stop sexual exploitation and child abuse where images of "real" children were depicted.

But in a landmark ruling he decided that the mere fact that they were not realistic representations of human beings did not mean that they could not be considered people.

He ruled that the animated cartoon could "fuel demand for material that does involve the abuse of children," and therefore upheld the conviction for child pornography.
Rather than jail the man, however, he fined him Aus$3,000 (US$2,000).

Sounds about right..... in your opinion does this make any sense?

It is a slippery slope, that's for sure. However, I agree in this case. The characters are depicted as children on the show, so for all intents and purposes they are children.

Why someone would find that tittilating in the first place is another story altogether!8O

It is a slippery slope, that's for sure. However, I agree in this case. The characters are depicted as children on the show, so for all intents and purposes they are children.

I think they were meant as a joke...not an overly funny one mind you...

I agree that it's a slippery slope...and the creators of anime better be careful what they draw...

Well if they're the cartoons I've seen pop up banners for on a few torrent sites I've ventured on, then yeah, having rod and todd ganging lisa simpson with all detailed body parts would be what I consider child porn related.

And no, I didn't click on the pop up, it had all that in the flashing advertisement.... more then I was wanting to know at the time.

That's why I figured I'd post this article, because I believe I've seen the pop ups around the net in the last couple of months for this crap and now I see someone got the boots to their head over it.

I can see why courts would want to declare it child porn. But, I can honestly see how the guy wouldn't have necessarily been looking at it that way. I would support the courts 100% in declaring it to be pornographic in nature (and child porn at that), and demanding its removal from computers, etc. But... when setting legal precedent, I don't agree with hitting the person in question in the article with charges (at least not max charges) for possessing it. I would be very hesitant to throw the label of 'possessing child pornography' onto a person over this case until the precedent is clearly set.

did the judge see bart's penis? theres no way a normal child would have such a large phallus. i don't believe that the judge can convict him for child pornography if his reasoning was that it "could" fuel demand for actual child porn. If it did then investigators should have found other child pornos in the offender's database. Pretty weak rational in my opinion

Which is probably why the judge only fined him and did not sentence him to any jail time. That would have opened another can of worms completely.

I guess it depends on the intent, I know the the types of pop up banners you are talking about, that probably would classify as porn. The creator of the offending material in Australia, was it a bad attempt at humour or just a way to conceal paedophilia as cartoons, bypassing criminal laws in the process?

umm i think it was created for people who have fantasies of cartoon characters. I've seen some done with king of the hill, family guy, and american dad

Indeed.... it's becoming it's own little porn genre/fetish for some people to see cartoon porn which can have many things in the video or pictures that would either be impossible or illegal to have done in real life and there are some odd people out there who get their jollies off of these things.

In my opinion, creating a cartoon or comic where it is minors having sex is just as bad (Depending on the content) then real porn that involves minors.

In a sense with this genre jumping into child porn, it is not only a side thought that child pornography is simply ok for those creating it and those downloading it, but the fact that you're using a mostly child-based media outlet such as cartoons to pass along that message makes it all the more worse.

The way I see it, is if it's pretty difficult to have cartoons these days with characters who smoke all the time or do other types of drugs, then you shouldn't be allowed to do the same with child porn.

And yes, I am aware of the lines that South Park, Simpsons, Robot Chicken and Family Guy all cross from time to time, however the majority of everything I have seen in most of those, all concentrate on the controvertial stuff being applied to "Adult" characters, in shows that are designed for adult viewers.

And of course someone could say these cartoons in question were geared for adult viewers, but then you have the child porn aspect of it, and throws it completely out of the circle of the above listed cartoons.

Keep the cartoons adult based with adult characters and there shouldn't be a problem, as I see it.

I agree Praxius. The problem is not cartoon characters having sex(it could be funny to see Family Guy porn with Peter and Lois), it's cartoon children having sex. That isn't right, no matter what medium it ends up as.

it's not right. But it's nowhere near as bad as photographic child porn. The major mitigating factor being that children are never involved inthe process. But yes the message it conveys is bad and therefore should not be allowed. I like porn... but i DONT like it when i find myself on a site with that kind of thing on it, which happens even in mainstream sites

Oh that's how they get ya man..... when you're a little kid you see your dad's or your uncle's porn mags..... the gateway drug..... then you get into the cheesy porno late at night on the sat. or on show case, if not then from porno stores....... then the internet to get what you really want..... then you see these other links on the side of the pages and go "WTF is that supposed to be?" then click...... then it's game over man, Satan has you're soul.... you're into some sick and twisted sh*t......

..... and then the cops come and you say "What, I don't know what you're looking for, I ain't into that stuff..." And then they show you what they found and it was one of those stupid links you clicked into and stayed a wee bit too long.

And to jail you go.... word gets around on what you like. Showers are worse then lunchtime, people are shouting your name relating to some deformed form of death late at night through the cells, and before you know it, you're raped and shanked for dead.

And that's why you don't do drugs.

No wait a min..... That's why you don't do porn, it leads to a life of degrade until there's nothing left but a life of crime and death in a cold cell somewhere.

Or at least that's what they'd be teaching right along with Creationism in the school down south :p (That's a joke people, chill)

I've been into all sorts... I used to like redhead porn. then i got into pregnant porn and lesbian porn, then asians. Nowadays it's all about user-submitted porn. But I have to say i've never ever been remotely interested in any of the toon stuff, even toons involving adults. it's just not real. and reality is what I like.
