Henry was found guilty of a series of sexual assaults in the early 1980s. He was picked out of a bogus police lineup that featured police officers and Henry being held in a choke hold.

words fail me....they should all be prosecuted, pensions stripped etc.

You got that right, and they are still squandering tax dollars on these f**king reprobates that murdered the immigrant at Vancouver airport 7 years ago. Those f**kers should have they key thrown away and never again see the light of day!

yeah, it doesn't, why is that...why do they not have to answer to us for such crimes and how is it possible they can step forward with a straight face and say it wasn't done maliciously or even contemplate not giving him money...

they never seem to worry about their reputations being besmirched or the legality of destroying some innocents life...

Soon after, Henry's bid for damages began, but it has been denied in B.C. courts.

"At this stage in the proceedings, the Crown has argued that his claim should not proceed as Mr. Henry is unable to show that the implicated Crown prosecutors acted maliciously," the BCCLA said. "The British Columbia Court of Appeal agreed, and Mr. Henry has been granted leave to appeal that decision to the Supreme Court of Canada."

What constitutes maliciousness? wouldn't this "the prosecution failed to disclose a number of key facts, including the discovery of DNA evidence, the existence of an alternative suspect, and the occurrence of similar sexual assaults after Mr. Henry’s arrest," constitute maliciousness?

Isn't the whole point of the justice system to put the RIGHT person behind bars. The GUILTY person? To that end shouldn't the prosecution make damn sure they've got the right person? Because if the answer is not a resounding yes, then there is something fully broken with our current system of policing and Justice.

This isn't just about the police force this is about police, crown council, and the justice system
itself. It is disgusting and should be seen as a criminal act in and of itself. The people who did
this knowing he wasn't guilty should spend an equivalent time in prison.
In addition the legal system itself now wants to hide behind some legal wording to avoid paying
Its time someone was held responsible

In a perfect world Twila! How is that ever going to happen when we have these fricken defense lawyers getting cases thrown out due to technicalities. Lawyers should be confined to seeing the accused gets a FAIR trial, NOT a pass to "walk"!

Damn right! When the Crown abuses due process to railroad innocent people, it's defence attorneys' fault!

You first.

A few young bruisers in their 20s standing about 6'6" and weighing 250 lbs. would be far more effective than a wizened shriveled up runt like myself.

So two wrongs make a right? Is it the Crown or is it "trigger happy" cops and witnesses?

The world needs more people like you, Sal, with a strong voice against this kind of garbage and a solid boot to give them a kick in the nuts!:)
